    FORT WORTH, Texas – An attorney says the Army psychiatrist charged in the worst mass shooting on a U.S. military base will soon be moved to a county jail near Fort Hood after four months in a military hospital.

    Defense attorney John Galligan says Maj. Nidal Hasan could be moved this week.

    Bell County Jail administrator Bob Patterson says Hasan will be housed in a cell at the medical unit.

    Patterson said Monday the facility is prepared to handle inmates with special medical needs.

    Hasan was taken to a San Antonio military hospital shortly after the Nov. 5 Fort Hood shootings. Civilian police officers shot him during the attack, leaving him paralyzed below the chest.

    Hasan faces 13 counts of premeditated murder and 32 counts of attempted premeditated murder.

    FORT HOOD, Texas – Wearing his Army uniform and sitting solemnly in a wheelchair, the psychiatrist accused of gunning down 13 people at Fort Hood made his first courtroom appearance Tuesday and won a delay in his case.

    Maj. Nidal Hasan, who was paralyzed after being shot by two Fort Hood police officers, only spoke when answering questions about the proceedings with a soft: "Yes, sir."

    His attorneys sought a delay in his Article 32 hearing because they needed more time to review reams of documents they recently received and still lacked other key documents, including the FBI ballistics report and a government review on the Nov. 5 shootings.

    The Article 32 hearing, similar to a civilian grand jury proceeding in which a judge hears witness testimony to determine whether the case should go to trial, is set for Oct. 4.

    Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the worst shooting on a U.S. military post.

    Before Tuesday's one-hour hearing, Hasan was flanked by military police as he rolled his wheelchair into the courtroom and up to the defense table. One of his attorneys said Hasan was cold, and later an attorney draped a large seafoam-green blanket around his shoulders. Hasan pulled it tightly against him and sometimes covered his nose with it during the proceeding.

    He answered "yes, sir" or "I understand, sir" when asked if he understood his rights, if he had read the charges against him and if he knew his right to a speedy trial.

    Officials had increased security at Fort Hood on Tuesday, blocking off the road to the court building, having bomb-sniffing dogs search the parking lot and using hand-held metal detectors to screen the few people approved to be in the court. Usually, none of those precautions are taken.

    Col. Michael Mulligan, the lead prosecutor, objected to delaying the Article 32 and said prosecutors would be ready to proceed in July. He said prosecutors did not yet have the FBI ballistics report or government review but would continue working to provide those to the defense.

    Col. James L. Pohl, a military judge who is acting as the investigating officer in the case, said he planned to call the 32 injured victims as witnesses during the Article 32 hearing.

    Pohl said that while authorities have not decided whether to seek the death penalty, he was asked to investigate whether Hasan's case had any aggravating factors — which are only relevant in death penalty cases. Pohl said he then asked prosecutors about it, which is why they sent a notice last month to defense attorney John Galligan outlining one aggravating factor: multiple deaths in the same incident.

    If convicted, Hasan could be sentenced to death only if the military jurors determine there is an aggravating factor, according to military law.

    Hasan is awaiting a mental evaluation, which is to be conducted sometime after the Article 32 hearing. Doctors will determine whether Hasan had a severe mental illness at the time of the shooting. If so, they will offer a clinical psychological diagnosis and determine whether it prevented Hasan from knowing his alleged actions were wrong at the time, and if he is competent to stand trial, according to military law.

    While Tuesday's hearing was the second for Hasan, it was the first time he'd appeared in a Fort Hood courtroom. His initial hearing — two weeks after the shootings — was held in his hospital room at San Antonio's Brooke Army Medical Center.

    Hasan was treated at the San Antonio facility until his April transfer to the Bell County Jail, which houses military suspects for nearby Fort Hood. The military justice system does not have bail for defendants.

    WASHINGTON – Nine Army officers are being reprimanded for leadership failures in connection with the shooting rampage at Fort Hood, Texas, and their failure to detect and report problems with the accused shooter, Maj. Nidal Malik Hasan, as he moved along in his medical career.

    Saying that although no single event directly led to the tragedy, Army Secretary John McHugh found that certain officers failed to meet expected standards, an Army statement said Thursday. The officers — all lieutenant or above — will receive punishments ranging from an oral reprimand to the far more serious written letter of censure that is considered a career-ender.

    Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the November 2009 shooting spree on the Texas military post.

    A Pentagon review last year found that Hasan's supervisors at Walter Reed Army Medical Center where he worked expressed serious concerns about his questionable behavior and poor judgment but failed to heed their own warnings. It said the Army psychiatrist's supervisors continued to give him positive performance evaluations that kept him moving up through the ranks despite worries about his strident views on Islam and worries about his competence.

    In one episode, Hasan reportedly gave a class presentation questioning whether the U.S.-led war on terror was actually a war on Islam. And fellow students said he suggested that Shariah, or Islamic law, trumped the Constitution, and that he also attempted to justify suicide bombings.

    The review, however, found that no one in Hasan's chain of command blocked his ability to hold a secret security clearance or stop his continued assignments, including his move to Fort Hood.

    Earlier this year a Senate review came to similar conclusions, saying the Defense Department and the FBI had sufficient information to detect that Hasan had been radicalized to violent extremism, but they failed to act on it.

    Commenting late Thursday, Sen. Susan Collins, R-Maine, said the Defense Department "failed to act on Hasan's obvious radicalization by either disciplining him or discharging him — actions that could have been taken under existing personnel and extremism policies. Hasan's increasing extremism was well known to his supervisors and colleagues at Walter Reed as was his poor performance."

    Sen. Joe Lieberman, I-Conn., added that the discipline meted out by McHugh will "send a clear message to everyone that the Army will not tolerate such negligence and passivity in reaction to clear signs that a soldier is radicalizing to Islamist extremism."

    Lieberman and Collins are chairman and ranking member of the Senate Homeland Security and Governmental Affairs Committee, which issued the Senate review.

    A joint terrorism task force overseen by the FBI learned late in 2009 of Hasan's repeated contact with U.S.-born radical cleric Anwar al-Awlaki, who encouraged Muslims to kill U.S. troops in Iraq. The FBI has said the task force did not refer early information about Hasan to superiors because it concluded he wasn't linked to terrorism.

    The Army did not release the names of the officers or the types of reprimands they all are receiving, but it is unlikely any are generals. The officers can appeal the punishments, and it may be several weeks before the actions are final.

    McHugh also has ordered a review of the Army's evaluation system to see whether it can be improved so there would be more accurate personnel reviews.

    He also directed the Army surgeon general to review policies and procedures for training, counseling and evaluating medical officers.

    We all know that tolerance, political correctness, and the perceived mistreatment of Muslims would have never allowed anything to be done to Hasan. Now the U.S. government/military is passing the blame on to some servicemembers in order to save face. If Hasan wouldn't have killed those soldiers, and if the officers would have pushed to have actions taken against Hasan for his previous conduct, it is almost guaranteed that they would have been blamed for being racist, bigoted, or anti-Muslim, which would have led to their court martial or other form of removal from military service.

    Somebody better tell the Military how to protect the troops, the military establishment has shown little skill in this area. Why are US Soldiers, or at least Officers and NCOs, not REQUIRED to have their weapons with them on base? Or at least during duty hours? I am not even suggesting having them armed 24 hours a day as the Israeli military does to protect its forces; I do not beleve that most would feel comfortable allowing service members that level of responsibility.

    Current service regulations do not even allow concealed carry by license holders. Someone needs to call for a sanity check on the way Force Protection is handled today.

    FORT WORTH, Texas (AP) — The Army psychiatrist charged in the worst mass shooting on a U.S. military installation will be tried in a military court and face the death penalty if convicted, Fort Hood's commanding general announced Wednesday.

    Maj. Nidal Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the November 2009 shooting spree on the Texas Army post.

    A military judge has not been named in the case, and it was not immediately clear when Hasan will be arraigned in a Fort Hood courtroom. He must plead not guilty because it is a death-penalty case, according to military law.

    Lt. Gen. Donald Campbell's decision for Hasan to face a military trial and the death penalty came as no surprise and echoed the recommendations of two Army colonels who also reviewed the case.

    "I believe the Army as an institution has long been planning to go this route," Hasan's lead attorney John Galligan told The Associated Press on Wednesday from his office near Fort Hood, about 125 miles south of Fort Worth.

    Many relatives and friends of those who survived the attack on that sunny autumn day reveled in the news Wednesday on social media sites. Staff Sgt. Jeannette Juroff, who was working in a nearby building that day and helped wounded soldiers, said many people affected by the tragedy feel that death is the only appropriate punishment.

    "If he's convicted and sentenced to death, maybe the (victims') families can get closure because he won't be here anymore and we'll no longer have to talk about him," Juroff told the AP.

    Leila Hunt Willingham, whose brother, Spc. Jason Dean "J.D." Hunt was killed that day, said she has mixed emotions about how Hasan's case will proceed.

    "I'm glad I'm not the one deciding what happens to Hasan," she said. "People think the default (emotion) is always anger and revenge. ... No one seems to understand that the outcome of this will not bring any more peace or closure than what I can get on my own. No matter what happens to Hasan, my brother is still dead."

    Keely Cahill Vanacker, whose father Michael Grant Cahill was the lone civilian killed in the rampage, said she doesn't think about Hasan.

    "This may be unusual and certainly not everyone's opinion, but worrying about what happens to the man who killed my father — I don't spend time thinking about it," Vanacker said. She said she has "full faith in the prosecution team. There will be a fair trial and justice will be done."

    Galligan had urged Fort Hood's commander at a meeting in May not to seek the death penalty against his client, saying such cases were more costly, time-consuming and restrictive. In cases where death is not a punishment option for military jurors, soldiers convicted of capital murder are automatically sentenced to life imprisonment without parole.

    Galligan has declined to say whether he is considering an insanity defense for his client. He has refused to disclose results of a military mental health panel's evaluation of Hasan.

    The three-member panel determined whether Hasan is competent to stand trial and his mental state during the shootings. It also determined if he had a severe mental illness that day, and if so, whether such a condition prevented him from knowing at the time that his alleged actions were wrong.

    Hasan, 40, was paralyzed from the waist down after being shot by police the day of the rampage. He remains jailed in the Bell County Jail, which houses defendants for nearby Fort Hood.

    Hasan has attended several brief court hearings and an evidentiary hearing last fall that lasted about two weeks. He sometimes took notes and showed no reaction as 56 witnesses testified, including more than two dozen soldiers who survived gunshot wounds.

    Witnesses testified that a gunman wearing an Army combat uniform shouted "Allahu Akbar!" — which is Arabic for "God is great!" — and started shooting in a small but crowded medical building where deploying soldiers are vaccinated and undergo other tests. The gunman fired rapidly, pausing only to reload, even shooting some people as they hid under tables or fled the building, witnesses said. He fatally shot two people who tried to stop him by throwing chairs, and killed three soldiers who were protecting civilian nurses, according to testimony.

    The gunman was identified as Hasan, an American-born Muslim who was scheduled to deploy to Afghanistan the following month. Before the attack, Hasan bought a laser-equipped semiautomatic handgun and repeatedly visited a firing range, where he honed his skills by shooting at the heads on silhouette targets, witnesses testified during the hearing.

    HOUSTON (Reuters) - A U.S. Army psychiatrist charged in a 2009 killing rampage at a Texas military base will face a court-martial where he could be sentenced to death, a military official ruled on Wednesday.

    Major Nidal Malik Hasan, 40, who U.S. officials have linked to a radical Muslim cleric in Yemen, is charged in the Fort Hood shootings killed 13 people and wounded 32 others.

    Lieutenant General Donald Campbell, Fort Hood's commander, referred Hasan's case to a general court martial which "is authorized to consider death as an authorized punishment," according to a statement issued by Fort Hood.

    A date has not been set for the court martial, the statement said. The first likely step would be for a military judge to inform Hasan of his rights at an arraignment, it said.

    John Galligan, Hasan's lead attorney, declined to comment on whether Hasan will pursue an insanity plea for his defense.

    "This thing has been choreographed a long time ago," Galligan said. "We're just seeing the various events play out."

    According to witnesses who testified at evidentiary hearings at Fort Hood in 2010, Hasan shouted "Allahu Akbar" -- Arabic for "God is Greatest" -- just before opening fire on a group of soldiers undergoing health checks before being deployed to war zones in Iraq and Afghanistan.

    Hasan is confined to a wheelchair after he was paralyzed from the chest down by bullet wounds inflicted by civilian police officers during the November 5, 2009 shooting.

    The incident has raised concerns over the threat of "home-grown" militant attacks. U.S. officials said Hasan had exchanged e-mails with Anwar al-Awlaki, an anti-American al Qaeda figure based in Yemen.

    Fort Hood is a major deployment point for the wars in Afghanistan and Iraq.

    Before the bloody day, Hasan had defended suicide bombings and told fellow soldiers that Muslim service members would be justified in killing US troops.

    Was he reported? Nope. Try promoted.

    (So much for his being a disgruntled worker.)

    The FBI even knew of Hasan’s communications with Anwar al-Awlaki, then one of the world’s most wanted terrorists, in which Hasan asked about carrying out jihad against the United States.

    Yet in President Obama’s remarks at a memorial service for Fort Hood’s fallen, he never used the word terrorism. Not once.

    Why is the administration trying to rewrite history? Comments by the Army’s chief of staff at the time, Gen. George Casey, might offer clues: “As horrific as this tragedy was, if our diversity becomes a casualty, I think that’s worse.”

    There was an effort, that is, to dismiss Islamist terror — and not offend Muslims.

    Legislation that would award the injured from the 2009 Fort Hood shooting the Purple Heart would adversely affect the trial of Maj. Nidal Hasan by labeling the attack terrorism, according to a Defense Department document obtained by Fox News.

    The document comes following calls from survivors and their families for the military honor, because they say Fort Hood was turned into a battlefield when Hasan opened fire during the November 2009 attack. Fox News is told that the DOD “position paper” is being circulated specifically in response to the proposed legislation.

    The document reads in part:

    “Passage of this legislation could directly and indirectly influence potential court-martial panel members, witnesses, or the chain of command, all of whom exercise a critical role under the Uniform Code of Military Justice (UCMJ). Defense counsel will argue that Major Hasan cannot receive a fair trial because a branch of government has indirectly declared that Major Hasan is a terrorist — that he is criminally culpable.”

    A source with knowledge of the position paper told Fox News that DOD is putting on a full-court press by sending senior officials, including generals, to meet with lawmakers in an effort to block support.

    Munley and dozens of other victims have now filed a lawsuit against the military alleging the “workplace violence” designation means the Fort Hood victims are receiving lower priority access to medical care as veterans, and a loss of financial benefits available to those whose injuries are classified as “combat related.”

    Legislation that would award the injured from the 2009 Fort Hood shooting the Purple Heart would adversely affect the trial of Maj. Nidal Hasan by labeling the attack terrorism

    Since 9/11 I have said this is one war, with 3 theaters; Iraq, Afghanistan, and the U.S.

    How could it NOT be, with TSA agents feeling people up at the airport, allegedly to prevent an attack by the people we’re at war with?

    If the U.S. isn’t one of theaters of the war, time to disband DHS and TSA.

    The actors are in place...the trial is ready to take center stage

    While everybody is focused on the three-ring circus that is Attorney General Eric 'Fast & Furious' Holder, the theater of the absurd continues as Nidal Hasan, the Army psychiatrist charged in the 2009 Ft. Hood shooting...you know the one Obama deemed 'workplace violence'...is now petitioning the court to represent himself when he goes to trial.

    Instead of just turning a blind eye to yet another of Hasan's never ending requests, yesterday, military judge Colonel Tara Osborn ordered Hasan to undergo a physical exam to determine whether he’s physically capable to do so (Hasan is paralyzed from the chest down from gunshots fired during the attack by two Ft. Hood police officers) after ruling him mentally capable to defend himself, and issued a statement through a Ft. Hood spokesman, “The judge noted that a prior inquiry into Hasan’s mental health indicated that he had the mental capacity to conduct and assist in his own defense."

    Now ordering the government to conduct the physical exam and file a medical report by tomorrow so she can rule on the results at Monday's scheduled hearing, this judge has been trying to keep the trial on schedule after countless Hasan initiated stalling tactics, including his stellar performance that as a muslim he should NOT be required to shave his beard to comply with military rules (Osborn set that issue aside).

    And if by some chance the judge refuses Hasan’s request to defend himself, rest assured he will appeal to higher courts and request the trial be stayed, causing even further delays.

    And so the delays will continue one way or another while we taxpayers foot the bill to keep Hasan well fed and laughing at how he's made a mockery of our justice system, because he knows that by defending himself new avenues for appeal become available if he's found guilty, and we all know he's guilty as charged. Defending himself also means that he’ll be able to question and cross-examine witnesses, including the very people he's charged with wounding, along with the family members of those he murdered in what was, whether Barack HUSSEIN Obama likes it or NOT, a terrorist attack.

    But gentleman that he is (insert sarcasm and look of utter disgust here), Hasan has graciously offered to plead guilty on all charges if the death penalty is taken off the table (something he has previously twice asked for). Judge Osborn again refused the request because under military law a defendant cannot plead guilty to a capital death penalty crime, making Hasan's offer just more theater, and believe me he knows damn well the military rules regarding his type of case.

    And it gets even more bombastically infuriating as in this theater of the absurd Nadal Hasan continues to get paid, racking up at least $278,000 in salary to date as he awaits the court-martial proceedings to begin, because under the Military Code of Justice, Hasan’s salary cannot be suspended unless he's proven guilty.

    Never mind that the people he injured all saw who shot them...never mind that he was seen murdering 13...never mind all that because the Military Code says he has to be officially adjudicated with a guilty verdict before his pay can be suspended or forfeited.

    Does anyone else see the absurdity in all this...

    And this is being played out while the victims are still being denied the Purple Hearts they so rightly deserve...Purple Hearts deserved because they were indeed injured in battle NOT in an act of 'workplace violence' for this muslim bast*rd kept shouting 'allahu akbar' as he pumped bullets into them...Purple Hearts that would allow the victims additional medical care and benefits for their families.

    And while the judge will explain to Hasan the many disadvantages of defending himself against 13 premeditated murder charges and 32 attempted premeditated murder charges, if she does rule Hasan is physically competent to represent himself at trial, she most probably will insist that defense attorneys be present to assist Hasan if he needs it, as military rules allow a judge to require a defendant representing himself pro se to still be advised by military lawyers thus preventing a possible mistrial due to what will assuredly be theatrical outbursts by the defendant.

    And what will Hasan do in representing himself...what will his defense be...NOTHING but jihadist rhetoric and rants using the qur'an to justify his actions, and the liberals sitting in the jury box...and rest assured there will be some bleeding heart liberals in that box...will lap it up so as NOT to appear racist against muslims (who are NOT a race by the way, but are people of all colors and nationalities who follow the pseudo-religious cult known as islam and NOTHING more).

    But if Hasan does become disruptive by spewing muslim garbage instead of questioning witnesses, which is very likely to happen, Hasan could lose the right to defend himself leaving it up to the judge and government lawyers to hold him accountable.

    Oh what theater we're all in for as the judge's ruling on Monday will determine if this trial becomes just more play acting at political correctness or if justice finally prevails for the Ft. Hood victims and their families.

    I've got my front row TV seat saved and my popcorn ready to be 'nuked'...it should be interesting to say the least.

    The shooting that took place in Fort Hood over two years ago was the worst mass murder ever to take place on an American military base. Thirteen people died and 29 were wounded by an Islamic radical shouting “Allah Akbar” as he fired. Yes – the killings were in the name of the God of Islam … Good ole Allah. The shooter, Nidal Hasan, was an Army Major serving as a psychiatrist. He is also a Muslim. He was inspired by radical Islamic cleric Anwar al-Awlaki, an al Qaeda leader in Yemen.
