Indictment: Vt. girl's uncle took her home for sex

BURLINGTON, Vt. - A 14-year-old witness told investigators a missing Vermont girl's uncle brought the girl to his home to initiate her into a child sex ring, federal officials said in an affidavit released Wednesday.

The 14-year-old told authorities she helped Michael Jacques, the missing girl's uncle, take the 12-year-old to Jacques' Randolph home on June 25 to be initiated into the ring. The 12-year-old has not been seen since then.

The 14-year-old girl, a relative of Jacques, said she understood that as part of the initiation, the 12-year-old "would have sex with adult males," according to the affidavit in U.S. District Court.

The girl said she and the 12-year-old watched television for a while before Jacques told her to leave and took the girl upstairs. The witness said she left the house with her boyfriend and did not see the girl again.

The 14-year-old said she herself had been sexually assaulted by Jacques, 42, since she was 9.

The Associated Press identified the missing girl prior to the assault allegations, but is no longer naming her because it does not generally identify people who are alleged victims of sexual assault.

Police find body of missing Vermont 12-year-old

The body of a missing 12-year-old Vermont girl was found Wednesday buried near her uncle's home, hours after documents surfaced that accused the man of planning to initiate her into a child sex ring.

Brooke Bennett's body was found about 4:45 p.m., about a mile from her uncle's house, said State Police Director Col. James Baker. Police who had been searching the uncle's property noticed the ground was disturbed and found her body buried underneath.

The girl's uncle, Michael Jacques, who has been in custody since Sunday on sexual assault charges involving another underage girl, is to be charged in federal court with kidnapping, police Sgt. Tara Thomas said. Bennett was last seen alive with Jacques at a convenience store last Wednesday.

"The painful discovery of Brooke's body today is tragic and heartbreaking," Baker said.

He called the death "clearly suspicious" but declined to give details before a planned briefing Thursday morning.

On Wednesday night, about 300 people gathered to mourn Bennett's death in what was originally organized as a candlelight vigil for the girl's safe return.

"Brooke Marie, I love you so much," her mother, Cassandra Gagnon, said sobbing. "I just ask that justice be done for the person who took my baby away."

The girl's father, James Bennett, added, "I know Brooke knows that we love her and will always love her."

Earlier Wednesday, in an affidavit unsealed in U.S. District Court in Burlington, the FBI said an unidentified 14-year-old girl told investigators she was present on June 25 when Jacques, 42, tricked Bennett into thinking she was going to a party and took her to his Randolph home to be initiated into a sex ring.

The girl said she was led to believe that the 12-year-old "would have sex with adult males" during the initiation.

The teenager said she and Bennett watched television for a while before Jacques told her to leave and took his niece upstairs. The witness said she left the house with her boyfriend and didn't see Bennett again.

The 14-year-old said she herself had been having sex with Jacques since she was 9, as part of the sex ring.

Bennett's former stepfather, Raymond Gagnon, appeared in federal court Wednesday on an obstruction of justice charge in the case. He was denied bail and was held pending a Monday hearing.

Police say Gagnon, 40, lives in Texas but often visited Vermont. According to the affidavit, he told police he accessed his former stepdaughter's MySpace page from a computer at his San Antonio home after getting login information from Jacques.

Police said they have evidence that postings to the account were altered to make it appear that the 12-year-old had discussed a secret rendezvous shortly before she disappeared.

Gagnon also told police he had downloaded child pornography onto the laptop, according to the affidavit.

Bennett's mother said she was "very surprised" by her ex-husband's alleged involvement.

this is so sad, saw it on Nancy Grace and my heart just sunk, her poor father I feel her mother should share just as much of the blame as the uncle.. what kind of parent allows their child to go out w/ a sex offender I wouldn't allow my dogs to be around a sex offender and what's that all about on the video when the mother tells Brooke she's not mad.. WTF does she need to be mad about? the fact she allowed her 12 yr old to go w/ a sex offender

The mother is sending a message to her deceased 12 year old that the MOTHER is not "mad" at her for having been abducted, initiated into a sex ring; molested, possiably raped, and then murdered, by men that the MOTHER allowed her to associate with - one a KNOWN sex offender ?

The mother isn't "MAD" at her daughter ??

Prosecutors: Deception ran deep in Vt. kidnapping

BURLINGTON, Vt. - A Vermont man whose 12-year-old niece was found dead near his home carefully orchestrated events and e-mails to make it appear she had gone to see someone she met online, prosecutors said Thursday as they charged him with kidnapping.

Michael Jacques, 42, could face the death penalty under federal law if convicted in the disappearance of Brooke Bennett. An autopsy has not confirmed whether the girl was killed.

Citing statements from another girl, prosecutors claim in an affidavit that Jacques tricked Brooke into thinking she was going to a party and instead took her to his Randolph home to initiate her into a child sex ring on June 25, the day she disappeared.

The girl's body was found Wednesday in a shallow grave near Jacques' house.

But no new evidence of a wider child sex ring has been found, beyond the claims of the 14-year-old that were released Wednesday in another affidavit unsealed in U.S. District Court in Burlington, officials said. "There's nothing from this investigation that's been turned up, nor otherwise are federal and state authorities aware of, any ongoing efforts to recruit young girls or boys here in Vermont to have sex with adults," Vermont Attorney General William Sorrell said at a news conference Thursday.

Authorities said they still weren't sure if there was a sex ring or whether there was a ruse Jacques might have used to intimidate the girls.

Michael Desautels, the federal public defender representing Jacques, didn't return calls Thursday.

Authorities say Jacques faked and altered postings to Brooke's MySpace pages in an effort to persuade investigators she planned to run off with someone she met through the social networking site. The tampering was discovered by the Internet Crimes Against Children Task Force, housed at the Burlington Police Department.

Jacques is charged under a federal law that provides for the death penalty in a kidnapping resulting in a child's death. In 1993, he was sentenced to six to 20 years in prison after being convicted of kidnapping and raping an 18-year-old woman he supervised at a Rutland restaurant, court records show. He successfully completed the state's sex offender treatment program in 2000 and was released from probation in 2006.

With autopsy results still pending, prosecutors said they could not say that Bennett was killed. If she was, U.S. Attorney Tom Anderson was asked whether he would seek the death penalty. "That determination would be made after the investigation is completed, after the case is presented to a grand jury and, ultimately, that decision is made by the attorney general of the United States of America," Anderson said.

The FBI affidavits support the charges against Jacques and against Bennett's former stepfather, Raymond Gagnon, who is charged with obstructing justice. Allegations in the affidavits include a claim by a 14-year-old that, at the age of 9, she was a "program for sex" called "Breckenridge" and that a male relative was to be her trainer. The girl told police that she was told she'd be killed if she didn't cooperate.

The teenager told authorities that Brooke was to be inducted into the sex ring the day she disappeared.
