Emails From Hillary Clinton’s IT Director at State Department Appear to Be Missing

The State Department said today it can’t find Bryan Pagliano’s emails from the time he served as Secretary of State Hillary Clinton’s senior information technology staffer during her tenure there.

Pagliano would have been required to turn over any official communications from his work account before he left the government. State Department officials say he had an official email account, but that they can't find any of those records he would have turned over and continue to search for them.

“The Department has searched for Mr. Pagliano’s email pst file and has not located one that covers the time period of Secretary Clinton’s tenure,” State Department spokesman Elizabeth Trudeau said today, referencing a file format that holds email.

“To be clear, the Department does have records related to Mr. Pagliano and we are working with Congress and [Freedom of Information Act] requesters to provide relevant material. The Department has located a pst from Mr. Pagliano’s recent work at the Department as a contractor, but the files are from after Secretary Clinton left the Department," Trudeau added.

After this story was posted, Trudeau reached out to ABC News, amending her previous statement to say that despite the absence of his original pst file, some small amount of Pagliano’s email has been recovered, suggesting they were gleaned from other email accounts.

This statement about Pagliano’s email comes in response to a FOIA request-turned-lawsuit by the Republican National Committee, which wants the State Department to turn over all his emails as well as Clinton’s text and Blackberry Messenger communications. In a court filing today, the RNC said the State Department has told them there are no documents responsive to either of those requests.

Pagliano was responsible for setting up the now-infamous private server in the basement of the Clinton's home in Chappaqua, New York. He has since become a key witness in the FBI inquiry into the handling of sensitive material on that server and has been granted immunity by the Justice Department in exchange for his cooperation.

“It’s hard to believe that an IT staffer who set up Hillary Clinton’s reckless email server never sent or received a single work-related email in the four years he worked at the State Department," the RNC's Deputy Communications Director, Raj Shah, said in a statement to ABC News. "Such records might shed light on his role in setting up Clinton’s server, and why he was granted immunity by the FBI. But it seems that his emails were either destroyed or never turned over, adding yet another layer to the secrecy surrounding his role.”

The State Department also pointed out that the Politico newspaper has previously reported that Pagliano’s emails were unavailable.

It's unclear why the State Department does not have his email records for the time her served as her IT director or whether or not he purposefully withheld them.

When Clinton's emails were published on the State Department's public reading room, only one email of his surfaced. It was a happy birthday message from his private email account to hers. She forwarded it to another staffer instructing him to "pls respond."

The Clinton campaign did not immediately respond to ABC News' request for comment.

What's Next in Hillary Clinton Email Investigation and What's at Stake

Late last week, sources confirmed the FBI had just finished interviewing a handful of former Secretary of State Hillary Clinton’s closest aides and advisers as part of an inquiry tied to her private email server, and that next it plans to ask Clinton herself for an interview, suggesting the review is nearing or entering its final stages.

Aside from defeating Donald Trump, it may be fair to say that this outstanding investigation about the handling of sensitive information on a private email server during her time at the State Department is the biggest obstacle on her path to the presidency. To clear that hurdle, the Justice Department must be convinced there was no criminal wrongdoing on her part.

As the FBI closes in on its decision, here's a look back at what got her to this point and what’s at stake going forward.

What Got Her Here?

Just days before she took office as secretary of state in 2009, Hillary Clinton set up her “clintonemail.com” domain for her and two of her top aides, Huma Abedin and Cheryl Mills. After using the account for about two months, she moved it to a private server used by her husband Bill Clinton, run out their basement in Chappaqua, New York. She used that account exclusively throughout her time in office, never using a government address.

The account came to light as a result of the House select committee investigating the 2012 Benghazi attack and was then catapulted into public view when the New York Times reported on it on March 2, 2015. Clinton turned over about 52,000 pages of her emails, after deleting 30,000 pages she said were private in nature. News organizations sued the State Department under freedom of information laws, seeking the emails, and a judge ruled that the State Department must make them public.

As the emails were slowly produced, the inspector general for the intelligence community believed there was enough cause to ask the FBI to investigate whether classified information was mishandled via that account. The State Department later said that 22 of her emails couldn’t be published because they contained top secret information. And a Washington Post analysis of the final production counts 104 emails she personally wrote that were deemed classified.

Where Does the Investigation Stand?

The FBI will be interviewing Clinton in the coming days, meaning the investigation may be nearing a conclusion about whether to levy any criminal indictments. Law enforcement sources tell ABC News that so far they are not aware of any evidence indicating criminal wrongdoing.

The FBI's upcoming interview with Clinton, who is well coached on the issue, is unlikely to change that. Her campaign has long maintained she never mishandled sensitive material and said recently it is “confident the review will conclude that nothing inappropriate took place."

But the FBI was able to recover many of the emails that Clinton herself deleted, and it hasn’t said if anything new or incriminating might have been gleaned from those files. And her top IT staffer, Bryan Pagliano, has been offered immunity by the Justice Department and is said to be cooperating with the investigation. He might have insight into some of the more critical questions, such as whether the intent of the private server was to hide information from the public and if it was ever hacked by foreign entities.


What's at Stake?

At stake is the fate of Clinton’s presidential campaign. It’s more than plausible that a criminal indictment, however unlikely, would derail her bid and force the Democratic party to put someone else on the ticket. And if Clinton were to be indicted for sending classified information over a private email server outside of government control, some might argue that other secretaries of state should face similar charges.

The State Department’s inspector general concluded two months ago that Secretary Colin Powell and aides to Secretary Condoleeza Rice handled classified information on private email accounts. At the time, both secretaries made arguments similar to those of Secretary Clinton -- that the information was being over classified.

One of Clinton’s standard lines about her email system popped up again over the weekend. We had examined this claim in detail back in August, noting that Clinton’s very careful and legalistic phrasing raises suspicions.

She refers to “material,” which could be code for documents, leaving open the possibility of “classified information” having been received. She also says she did not receive “any material marked classified,” which of course leaves open the possibility of receiving classified information that was not correctly marked. We gave her Two Pinocchios for excessively technical wordsmithing.

Separately, in February, we explored how “top secret” information ended up on her server. We said that the question of “markings” was a red herring. Anything marked classified could not be sent through an unclassified system — and officials are supposed to know enough about the sensitivity of communications to recognize material that could be considered classified under a presidential executive order.

Few of us have felt confident that Hillary Clinton would receive justice for her mishandling of our nation’s most classified information as Secretary of State. Her teflon coating, along with — shall we say — “connections” in the Obama administration, leave all but the most ever-optimistic and idealistic among us with little hope that she’ll be indicted, regardless of how what the FBI finds.


And now this. Turns out, the very people who may be tasked with her prosecution — the Department of Justice — have donated nearly $75K thus far to help the former secretary of state get elected.

The FBI’s investigation into the “secret server” Hillary Clinton used as President Obama’s top diplomat has not halted political contributions from the very department that may be tasked with her prosecution.

Donations from Department of Justice employees to the former secretary of state have dwarfed those made to her political opponents. Mrs. Clinton hauled in $73,437 thus far during the 2016 presidential cycle, compared to $8,900 for Vermont Sen. Bernard Sanders and $381 for Republican presidential front-runner Donald Trump.

“I’m not surprised in the least to see more evidence that shows the politicization of the Justice Department,” David Bossie, president of the watchdog group Citizens United, told the Washington Free Beacon Tuesday. “How can Democrat political appointees fairly investigate someone who is about to become their nominee for president?”

Twelve of the 228 donations by Justice Department employees to Mrs. Clinton reached $2,700, the maximum individual amount allowed by law, the website reported.

Mr. Bossie said the hefty donations are further proof that Attorney General Loretta Lynch should appoint a special counsel to determine whether Mrs. Clinton or her aides violated a subsection of the Espionage Act related to “gross negligence” in handling government documents.

“This investigation needs to be conducted free of political influence once and for all,” he added.

The renewed call for a special prosecutor was echoed today by Matthew Whitaker, the executive director of the DC-based watchdog Foundation for Accountability & Civic Trust (FACT).

The Clinton involuntary assisted suicide" list:

1 - James McDougal - Clinton's convicted Whitewater partner died of an apparent heart attack, while in solitary confinement. He was a key witness in Ken Starr's investigation.

2 - Mary Mahoney - A former White House intern was murdered July 1997 at a Starbucks Coffee Shop in Georgetown. The murder happened just after she was to go public with her story of sexual harassment in the White House.

3 - Vince Foster - Former white House councilor, and colleague of Hillary Clinton at Little Rock's Rose Law firm. Died of a gunshot wound to the head, ruled a suicide.

4 - Ron Brown - Secretary of Commerce and former DNC Chairman who had a serious disagreement with Clinton. Reported to have died by impact in a plane crash. A pathologist close to the investigation reported that there was a hole in the top of Brown's skull resembling a gunshot wound. At the time of his death Brown was being investigated, and spoke publicly of his willingness to cut a deal with prosecutors.

5 - C. Victor Raiser II and Montgomery Raiser, Major players in the Clinton fund raising organization died in a private plane crash in July 1992.

6 - Paul Tulley - Democratic National Committee Political Director found dead in a hotel room in Little Rock, September 1992...after a serious disagreement with Clinton. Described by Clinton as a "Dear friend and trusted advisor."

7- Ed Willey - Clinton fund raiser, found dead November 1993 deep in the woods in VA of a gunshot wound to the head. Ruled a suicide. Ed Willey died on the same day after his wife Kathleen Willey claimed Bill Clinton groped her in the oval office in the White House. Ed Willey was involved in several Clinton fund raising events.

8 - Jerry Parks - Head of Clinton's gubernatorial security team in Little Rock. Gunned down in his car at a deserted intersection outside Little Rock. Park's son said his father was building a dossier on Clinton. He allegedly threatened to reveal this information. After he died the files were mysteriously removed from his house.

9 - James Bunch - Died from a gunshot suicide. It was reported that he had a "Black Book" of people which contained names of influential people who visited prostitutes in Texas and Arkansas. Although the book was seen by several persons, it disappeared.

10 - James Wilson - Was found dead in May 1993 from an apparent hanging suicide. He had ties to Whitewater.

11- Kathy Ferguson, ex-wife of Arkansas Trooper Danny Ferguson, was found dead in May 1994, in her living room with a gunshot to her head. It was ruled a suicide even though there were several packed suitcases, as if she were going somewhere. Danny Ferguson was a co-defendant along with Bill Clinton in the Paula Jones lawsuit. Kathy Ferguson was a corroborating witness for Paula Jones.

12 - Bill Shelton - Arkansas State Trooper and fiancÈe of Kathy Ferguson. Critical of the suicide ruling of his fiancÈe, he was found dead in June, 1994 of a gunshot wound also ruled a suicide at the grave site of his fiancee. There were no powder burns.

13 - Gandy Baugh - Attorney for Clinton's friend Dan Lassater, died by jumping out a window of a tall building January, 1994. His client was a convicted drug distributor.

14 - Florence Martin - Accountant & sub-contractor for the CIA, was related to the Barry Seal Mena Airport drug smuggling case. He died of three gunshot wounds.

15 - Suzanne Coleman - Reportedly had an affair with Clinton when he was Arkansas Attorney General. Died of a gunshot wound to the back of the head, ruled a suicide. Was pregnant at the time of her death.

16 - Paula Grober - Clinton's speech interpreter for the deaf from 1978 until her death December 9, 1992. She died in a one car accident. She told a friend that Clinton made advances.

17 - Danny Casolaro - Investigative reporter. Investigating Mena Airport and Arkansas Development Finance Authority. He slit his wrists, apparently, in the middle of his investigation. Before his death, he claimed to have found a shattering story involving Clinton.

18 - Paul Wilcher - Attorney investigating corruption at Mena Airport with Casolaro and the 1980 "October Surprise" was found dead on a toilet June 22, 1993 in his Washington DC apartment. Had delivered a shocking report to Janet Reno three weeks before his death.

19 - Jon Parnell Walker - Whitewater investigator for Resolution Trust Corp. Jumped to his death from his Arlington, Virginia apartment balcony August 15, 1993. He was investigating the Morgan Guarantee scandal.

20 - Barbara Wise - Commerce Department staffer. Worked closely with Ron Brown and John Huang. Cause of death unknown. Died November 29, 1996. Her bruised, nude body was found locked in her office at the Department of Commerce.

21- Charles Meissner - Assistant Secretary of Commerce who gave John Huang special security clearance, died shortly thereafter in a small plane crash. The plane had been tampered with.

22 - Dr. Stanley Heard - Chairman of the National Chiropractic Health Care Advisory Committee, died with his attorney Steve Dickson in a small plane crash. Again, tampering with the plane. Dr. Heard, in addition to serving on Clinton's advisory council personally treated Clinton's mother, stepfather and brother.

23 - Barry Seal - Drug running pilot out of Mena Arkansas, death was no accident.

24 - Johnny Lawhorn Jr. - Mechanic, found a check made out to Bill Clinton in the trunk of a car left at his repair shop. He was found dead after his car had hit a utility pole. Apparently he was dead before the car hit the pole.

25 - Stanley Huggins - Investigated Madison Guarantee. His death was a purported suicide and his report was never released.

26- Hershell Friday - Attorney and Clinton fund raiser died March 1, 1994 when his plane exploded. This happen two days after an argument with Clinton.

27 - Kevin Ives and Don Henry - Known as "The boys on the track" case. Reports say the boys may have stumbled upon the Mena Arkansas airport drug operation. A controversial case, the initial report of death said, due to falling asleep on railroad tracks. Later reports claim the two boys had been slain before being placed on the tracks. Many linked to the case died before their testimony could come before a Grand Jury.

28 - Keith Coney - Died when his motorcycle apparently slammed into the back of a truck, July 1988. No one saw the accident and the bike was not damaged.

31 - Jeff Rhodes - He was shot, mutilated and found burned in a trash dump in April 1989.

33 - James Milan - Found decapitated. However, the Coroner ruled his death was due to "natural causes."

34 - Jordan Kettleson - Was found shot to death in the front seat of his pickup truck in June 1990.

35 - Richard Winters - A suspect in the Ives / Henry deaths. He was killed in a set-up robbery July 1989.

Obama Encourages State Dept. Suppression of Hillary Emails Until AFTER ELECTION, Even CNN is ENRAGED

There’s never been any doubt that the fix was in to ensure that Hillary Clinton would be the Democratic Presidential nominee, and that Bernie Sanders would end up being nothing more than a distraction, who would eventually be bought off.

And to that end, the State Department along with the White House is also doing its best to drag Hillary, despite the mounting scandals, into the Oval Office.

Surprisingly, this has raised the attention of CNN, once considered a Clinton supporter and in particular news host and commentator Jack Tapper, who took issue with Obama for refusing to release all of Clinton’s emails before doubling down by announcing that they would be released after the presidential election.

“At a certain point, one begins to wonder if these weaknesses are deliberate and that these efforts to conceal information do not conceal a certain disdain for the public and your right to know,” Tapper said.

He continued saying, “Turning now to a Obama administration decision that we learned about today, one that is, once again, at odds with President Obama’s much ballyhooed pledge to be the most transparent administration in history. The issue at hand, Hillary Clinton’s role in crafting the Trans-Pacific Partnership, which is the largest regional trade deal in history brokered while Hillary Clinton led the State Department, it’s a deal which the likely Democratic nominee vouched for as Secretary of State no fewer than 45 times between 2010 and 2013 and called it the gold standard of all trade deals.”
