School Is Out – My Kids Are to Be Given to Me’:
Dad Arrested After Objecting When School Says He Must Wait to Take His Children Home

A Tennessee father was arrested for disorderly conduct last week after objecting to an official school policy that apparently prohibited him from picking up his children on foot ahead of the majority of parents picking their children up in their cars.

The new student pick-up policy, which reportedly started last week, says that parents can only pick up their children after 2 p.m. by waiting in a line of cars until everyone is released at 2:35 p.m. In this particular case, the parent was walking, so it wouldn’t make much sense to wait in the line of cars.

As Jim Howe made his case to South Cumberland Elementary School Resource Officer Avery Aytes, the man’s fiancé recorded the entire exchange. In the roughly 6 minute discussion captured on video, Howe does not appear to seriously raise his voice or make any threatening gestures. It should be noted that there could be more to the video, however, the moment that Aytes arrests Howe appears to be shown in full context.

“I’m not raising my voice, I’m not confrontational, I want my kids,” Howe said in the YouTube video, later adding, “I can’t stand in line — I’m walking. Picking my kids up.”

“You’re trying to be difficult. You’re being childish,” Aytes replied.

Howe then referenced Tennessee state law and argued the school’s policy is illegal, further aggravating the school resource officer. “School is out – My children are to be given to me,” the dad said.

“It doesn’t say when!” Aytes shot back. “School is out, they will give you your child, but it doesn’t say when now does it?”

“Tennessee state law says within a reasonable amount of time, that is 15 minutes,” Howe says in the video, seconds before being put in handcuffs.

“Put your hands behind you back!” Aytes said as he detained the father. “I’m not staying here and arguing with you. You’ve been disorderly.”

The officer then placed Howe in a police vehicle after threatening to arrest his fiancé as well if she blocked traffic while filming him.

However, the sheriff also said he agrees with the father on principle, saying the policy is creating safety concerns because it has created a line of cars along the highway outside of the school.



Burgess said he is reviewing the policy and will make some recommendations this week as to what changes should be made to ensure student safety.

Howe is outraged that he was arrested for trying to pick up his kids. He says he doesn’t need a reason to pick up his own kids from school.

Many will see this as another form of creeping authoritarianism being introduced through the public education system, advancing the idea that the state and not parents have supreme authority over children.

It’s a concept also being promoted by the mass media. Earlier this year, MSNBC ran a segment pushing the notion that kids belong to the “collective,” and that the “idea that kids belong to their parents or kids belong to their families” should be eliminated.

At our schools the "Walkers" are allowed to gather in the Assembly Hall and leave as the "Bus Riders" are loaded up. This allows them to go ahead and get out of the way of moving traffic. Then the buses roll and the "Car Riders" are allowed to pick up their children. The photo above looks very much like the car lines here....

These people legitimately believe that your children are not yours! They believe that primary ownership belongs to the government. Thats why they teach them an agenda which is contrary to the beliefs held by many americans. Thats why they send social services to snatch them away and feel they can hold them in school, as long as they want. Its why they will deny you the right to take your own children home, and have you arrested for simply disagreeing with them. Oh and one last bit…they steal all of your hard earned money to fund these operations and expect you to thank them for it.

This officer is behaving foolishly. This country is turning into a dangerous place to live.

The cop that comes on such a scene and cannot discern that the problem lies with the school official, and walks away is no better than an officer in the SS circa 1930′s. Not after the rounding up and mass killings began, but before. He should have raised his hands and told the school official to comply with the simple request, and asked the parent to have a seat while the official complied with the parent and the cop.

The all encompassing “disorderly conduct” arrest. Nothing disorderly there. Using that as an example, everyone could be arrested for just talking.

This deputy was wrong on several levels, first off he wouldn’t allow this father to pick up his children which are the fathers responsibility to ensure they get home safely. Second the officer was the one being confrontational not the father. The officer threw his weight around pretty much and from the looks of it he could use a diet to boot. He abused his authority as arresting a father for something so stupid shows how desperate he is to meet a quota. Third, the officer was abusive to the fathers girlfriend when he threatened to arrest her for being where she could video the activities of this moron with a badge. This deputy reminds me of Barney Fife.. on a BK Diet
