    AP Challenges Carney: Doesn't Responsibility Rest With President Obama?

    White House Press Secretary Jay Carney fielded questions at the daily briefing on Tuesday on a broad spectrum of issues confronting the administration over the past week. A reporter from the Associated Press opened up the floor by challenging Carney on the "confluence of issues," saying that in the cases of Benghazi, the IRS, and the DOJ, "you've placed the burden somewhere else." With the Benghazi attack, the Obama administration cited political motivations on the Hill. In the case of the IRS flagging groups based on political ties, bureaucrats. In regards to the Justice Department's seizure of AP phone records, he pointed to Carney saying "matters are handled independently."

    The reporter trudged on. "But it's the president's administration. So I wonder, doesn't the responsibility for setting tone and setting direction ultimately rest with the president on these matters?"

    Carney began his response by saying that it is the job of the president to set tone, "and you see and hear him do that every day ... but I think you have to separate these issues."


    Pointing to the president's remarks on Monday in which he spoke about the "clear political circus Benghazi has become," Carney said that the president's response to questions about reports of activity by the IRS were entirely different.

    "He made clear if reports about activity prove to be true, he'd find them outrageous and expect appropriate action," he said. "He has no tolerance for targeting of specific groups." At this point, however, Carney stressed that the matter is under review by the IG and that any action needed to be taken will have to happen after that report becomes available. --

    On the issue of the DOJ's alleged seizure of AP phone records, Carney said, "Other than press reports, we have no knowledge of [an] attempt to seek phone records of the AP. We're not involved with ongoing criminal investigations. Those matters are handled by the Justice Dept," he said.

    Although he told the press that he "understands" questions about the DOJ's actions and 'understands them well,' Carney concluded that it would be inappropriate for him to have answers to a matter that is the subject of an investigation.

    Jay Carney Overwhelmed By Scandal at Press Briefing

    With the White House under fire by three different scandals - Benghazi, the IRS admitting that it targeted the Tea Party and other conservative groups and the Department of Justice secretly obtaining teh phone records of Associated Press reporters and editors - press Secretary repeatedly said that neither he nor Pres. Obama could comment on ongoing investigations and that Obama believes in the First Amendment and reporters' right to conduct investigative journalism.

    However, Carney said, the president had to strike a "balance" between preserving national security and preventing classified leaks and preserving the First Amendment ... but the White House Press Corps kept peppering away.

    On Benghazi, Carney repeated Obama's allegation that the controversy over the Benghazi was a politically-motivated "sideshow."

    A few weeks after President Obama took office, his attorney sent a memo that reversed all the claims about being an open and transparent administration

    Agencies were ordered to go through White House lawyers on every information request involving a so-called “White House equity” which was code for any and every issue they care about. Court subpoenas, official requests from Congress, news media requests, and public asks under the Freedom of Information Act—nothing was to be released without going through the filter of political lawyers in the White House, no matter what the law said about honoring requests promptly.

    And the names of requesters were put on a list — just like an enemies’ list.

    What’s called the “control freak” President insists on controlling what you get to know or not. That is what we call propaganda.

    Remember when the Obama Administration was meant to serve as the model for how a transparent government is supposed to operate? That promise of “hope’n’change” has produced the most secretive government administrations in the history of this nation.

    To add insult to injury, the Democrats have continually fought to defend the president’s violations, abuses and secrecy with a hubris not seen in government since the days of King Louis XVI.

    On Friday, Eleanor Holmes Norton, the non-voting congressional representative for the District of Columbia, defended the Obama Administration angrily as she declared that Americans have no right to know what goes on in their government.

    “You don’t have a right to know everything in a separation-of-powers government, my friend. That is the difference between a parliamentary government and a separation-of-powers government,” Norton claimed during a House Oversight and Government Reform Committee hearing.
    Allow me to make this clear: A Democrat representative told the House Oversight Committee that they have no right to scrutinize government. The committee, as the name would suggest, is responsible for overseeing the federal government as a check against abuses of power.

    What Norton seems to have confused is that it is the very principle of scrutiny that defines a government that is equipped with a separation of powers. Each branch of government checks the power of the other branches of government.

    It’s amazing that America possesses even one citizen who would believe such an obvious falsehood; it’s even more outrageous that America has a representative in Congress who believes this.

    Yesterday President Obama met with American Muslim leaders whose names the White House would not disclose -- so much for transparency in the House for which the taxpayers pay the bill. But do the secular humanists and radical atheists not see this as a violation of separation of church and state? Oops, I guess the operative word is "church"...mosque and state is cool. Now ask yourself, when was the last time American Christian, or even Jewish leaders were invited to a White House meeting? And no, Rev. Al Sharpton does not count. By the way, for all my dear liberal progressive socialist fans, just how much does Rev. Al owe in taxes? So many pertinent questions in just one little FB post.

    Obama quietly hands out names of Muslim leaders he met with privately

    The White House has finally divulged the names of American Muslim leaders who met with President Obama this week, including Imam Mohamed Magid, who has advised the administration on formulating responses to incidents that Islamists consider offensive.

    After stonewalling journalists for two days about the names of the participants at the meeting Wednesday, the White House quietly attached the list of attendees to the end of its daily press briefing transcript Thursday evening.

    The guest list identified Imam Magid as a representative of the Adams Center, a large mosque in Sterling, Virginia. He has also served as president of the Islamic Society of North America, according to the group’s website.

    Imam Magid, a native of Sudan, has served on the Department of Homeland Security’s Countering Violent Extremism Working Group and has worked as an adviser to the White House National Security Council to formulate U.S. responses to appeal to moderate Muslims in the battle against Islamist extremists.

    It was Mr. Obama’s first meeting with American Muslim leaders at the White House, coming at a time of renewed discussion about the threat of radicalization of Muslims in the West. The hourlong talk focused on civil rights, anti-Muslim bias, and extremism, according to participants.

    The other attendees were Bilqis “Qisi” Abdul-Qaadir, director of women’s basketball operations at Indiana State University; Arshia Wajid, founder of American Muslim Health Professionals; comedian Dean Obeidallah; Kameelah Rashad, founder of Muslim Wellness Foundation and Muslim chaplain at the University of Pennsylvania in Philadelphia; Diego Arancibia, board member and associate director of the Ta’leef Collective; Farhan Latif, chief operating officer and director of policy impact at the Institute of Policy and Understanding; Sherman Jackson, professor of religion and American Studies and Ethnicity at the University of Southern California; Azhar Azeez, president of the Islamic Society of North America; Farhana Khera, president of Muslim Advocates; Rahat Hussain, president of the Universal Muslim Association of America; Hoda Hawa, national policy adviser of the Muslim Public Affairs Council; Maya Berry, executive director of the Arab American Institute and Haroon Mokhtarzada, CEO of Webs.

    Also at the meeting were Mr. Obama’s senior adviser Valerie Jarrett, National Security Adviser Susan E. Rice and Deputy National Security Adviser Ben Rhodes.

    The White House said Mr. Obama “reiterated his administration’s commitment to safeguarding civil rights through hate crimes prosecutions and civil enforcement actions” during the meeting, and also discussed countering the Islamic State “and other groups that commit horrific acts of violence, purportedly in the name of Islam.”

    The president urged Muslim Americans “to remain civically engaged in their communities,” the White House said.

    The Justice Department named ISNA in a court document as an unindicted co-conspirator with other “entities who are and/or were members of the U.S. Muslim Brotherhood” during prosecution of a terrorist financing case in 2007 against the Holy Land Foundation, once the largest Muslim charity in the U.S.

    A federal judge later ruled that the document should not have been revealed to the public. The ISNA has said that its inclusion in the charitable foundation’s list of unindicted co-conspirators amounted to guilt by association.

    However, last week something happened even more damning for Obama (if that’s possible) — and he doesn’t seem to care. As you might recall, President Obama met with American Muslim leaders at the White House, but the administration was unwilling to reveal who attended the meeting, which was closed to the press.

    White House office to delete its FOIA regulations

    WASHINGTON — The White House is removing a federal regulation that subjects its Office of Administration to the Freedom of Information Act, making official a policy under Presidents Bush and Obama to reject requests for records to that office.

    The White House said the cleanup of FOIA regulations is consistent with court rulings that hold that the office is not subject to the transparency law. The office handles, among other things, White House record-keeping duties like the archiving of e-mails.

    But the timing of the move raised eyebrows among transparency advocates, coming on National Freedom of Information Day and during a national debate over the preservation of Obama administration records. It's also Sunshine Week, an effort by news organizations and watchdog groups to highlight issues of government transparency.

    "The irony of this being Sunshine Week is not lost on me," said Anne Weismann of the liberal Citizens for Responsibility and Ethics in Washington, or CREW.

    "It is completely out of step with the president's supposed commitment to transparency," she said. "That is a critical office, especially if you want to know, for example, how the White House is dealing with e-mail."

    Unlike other offices within the White House, which were always exempt from the Freedom of Information Act, the Office of Administration responded to FOIA requests for 30 years. Until the Obama administration, watchdog groups on the left and the right used records from the office to shed light on how the White House works.

    "This is an office that operated under the FOIA for 30 years, and when it became politically inconvenient, they decided they weren't subject to the Freedom of Information Act any more," said Tom Fitton of the conservative Judicial Watch.

    That happened late in the Bush administration, when CREW sued over e-mails deleted by the White House — as many as 22 million of them, by one accounting. The White House at first began to comply with that request, but then reversed course.

    "The government made an argument in an effort to throw everything and the kitchen sink into the lawsuit in order to stop the archiving of White House e-mails," said Tom Blanton, the director of the National Security Archive at George Washington University, which has used similar requests to shed light on foreign policy decisions.

    In 2009, a federal appeals court in Washington ruled that the Office of Administration was not subject to the FOIA, "because it performs only operational and administrative tasks in support of the president and his staff and therefore, under our precedent, lacks substantial independent authority."

    The appeals court ruled that the White House was required to archive the e-mails, but not release them under the FOIA. Instead, White House e-mails must be released under the Presidential Records Act — but not until at least five years after the end of the administration.

    In a notice to be published in Tuesday's Federal Register, the White House says it's removing regulations on how the Office of Administration complies with Freedom of Information Act Requests based on "well-settled legal interpretations."

    The rule change means that there will no longer be a formal process for the public to request that the White House voluntarily disclose records as part of what's known as a "discretionary disclosure." Records released by the Office of Administration voluntarily include White House visitor logs and the recipe for beer brewed at the White House.

    "You have a president who comes in and says, I'm committed to transparency and agencies should make discretionary disclosures whenever possible, but he's not applying that to his own White House," Weismann said.

    The White House did not explain why it waited nearly six years to formally acknowledge the court ruling in its regulations.

    Blanton said the outdated regulation is part of a larger problem of outdated FOIA regulations: Most federal agencies haven't updated their rules to take into account changes in law, many of which benefit requesters.

    White House spokeswoman Brandi Hoffine said the administration remains committed "to work towards unprecedented openness in government."

    "Over the past six years, federal agencies have gone to great efforts to make government more transparent and more accessible than ever, including by making more information available to the public via our Open Government initiative and improving the FOIA process," she said.

    In the notice to be published Tuesday, the White House said it was not allowing a 30-day public comment period, and so the rule will be final.

    "It's a little tone deaf to do this on Sunshine Week, even if it's an administrative housecleaning," said Rick Blum, coordinator of the Sunshine in Government initiative for the Reporters Committee for Freedom of the Press.

    The bigger issue, Blum said, is that the Office of Administration is itself responsible for presidential record-keeping. Given the controversy over former secretary of State Hillary Rodham Clinton's use of a personal e-mail account to conduct official business, there ought to be more scrutiny of record-keeping practices, he said.

    "I think what we've all learned n in the last few weeks is the person who creates a record — whether it's running a program or writing an e-mail — is the one who gets to decide whether it's an official record," Blum said. "And there ought to be another set of eyes on that. That's the essential problem."
