    Catholic Bishops Reject Obama Offer on Contraceptive Coverage

    U.S. Roman Catholic bishops on Thursday rejected the Obama Administration's latest bid for compromise over a hotly disputed health policy that requires employees at religiously affiliated institutions to have access to insurance coverage for contraceptives.

    Dolan criticized the administration for not addressing the issue of business owners who also oppose the policy on religious grounds. "We cannot now abandon them to be forced to violate their morally well-informed consciences," he said. "We will continue to stand united with brother bishops, religious institutions, and individual citizens who seek redress in the courts for as long as this is necessary."

    The proposed rules, issued on Feb. 1 by the U.S. Department of Health and Human Services, would allow religiously affiliated employers to avoid paying for coverage. Private insurers would instead provide birth-control benefits through separate insurance policies.

    Administration officials say insurers that provide group plans would be compensated by lower costs from fewer pregnancies and abortions.

    Religiously affiliated institutions that provide their own health insurance for workers or students would be served by third-party administrators.

    Cardinal Timothy Dolan of New York, president of the U.S. Conference of Catholic Bishops, said his group would redouble efforts to reach an agreement on the contraceptives issue after more than a year of protest and scores of federal lawsuits from Catholics groups and other social conservatives.

    But the cardinal, one of the most prominent voices in the American Catholic Church, said new federal rules proposed last week offer only "second-class status" to church-affiliated universities, hospitals and charities by failing to grant them the same full exemption afforded to houses of worship."These ministries are integral to our Church and worthy of the same exemption as our Catholic churches," Dolan said in a statement released by the bishops conference. "The government would require all employees in our 'accommodated' ministries to have the illicit coverage - they may not opt out, nor even opt out for their children," he said.

    His remarks, coming on the heels of rejections from other opponents, including the Becket Fund for Religious Liberty, illustrate the scale of resistance facing one of the most controversial provisions of President Barack Obama's 2010 Patient Protection and Affordable Care Act.

    The Catholic Health Association of the United States, the leading church-affiliated healthcare provider, declined to comment on Thursday, saying it was still seeking input from its 2,200 members, including 600 hospitals.

    The contraceptives coverage is backed by liberal Catholic groups and women's rights activists.

    The healthcare law already requires secular employers to cover all contraceptives and sterilization methods approved by the U.S. Food and Drug Administration, including the "morning after" pill.

    But the administration is trying to reach an accommodation for religious nonprofit institutions whose employees would begin receiving coverage on Aug. 1.

    Third-party administrators would find an outside insurer to provide the contraceptives coverage. Those insurers' higher costs would then be compensated by lower user fees for participating in state-based healthcare exchanges, which are scheduled to begin operating on Jan. 1, 2014.

    The proposed regulations are open for public comment through April 8.

    "We have been assured by the administration that we will not have to refer, pay for, or negotiate for the mandated coverage. We remain eager for the administration to fulfill that pledge," Dolan said.

    "We welcome and will take seriously the administration's invitation to submit our concerns through formal comments, and we will do so in the hope that an acceptable solution can be found."

    Judge: Catholic Company Doesn’t Have to Follow Obama HHS Mandate

    federal judge in Minnesota has given a Catholic-owned and operated business a reprieve from the onerous provisions of the Obamacare HHS mandate. The mandate compels companies to pay for birth control and drugs for their employees that may cause abortions.

    U.S. District Court Judge John R. Tunheim issued a ruling yesterday for an injunction against complying with the mandate for American Manufacturing Company. The attorney for the client, Thomas Mathews, told a news outlet, “He was conflicted with owning a company that would provide the types of insurance that he finds morally offensive and objectionable.”

    In working with its current insurance company, Medica, American Manufacturing was able to cut the birth control coverage from an existing group health insurance plan.

    Now, it awaits a decision on two other preliminary injunctions in the 8th Circuit of federal district courts.

    Mathews says he’s been interviewed by the New York Times about his case, and counsel for the case has told him this might be used as precedent in a Supreme Court decision.

    Mathews said he’s seen “some negative reaction from those who don’t understand Greg’s deep conviction with this.”

    He said it’s not a case of anti-feminism, as some have alleged, but it’s motivated by deeply-held Catholic beliefs.

    We were issued the very first preliminary injunction against the mandate in the State of Minnesota. Also, by the tremendous effort of my legal team we were able to convince (again for the first time) one of the major insurance carriers to accept the injunction and provide my employees with medical insurance devoid of the “women’s preventative services”; praise the Lord!

    The reason for emailing you is that I have undertaken this suit not only for my own personal company (although that was a big factor) but so that other faithful Catholic business owners would see that we can’t sit by and just accept what is being mandated. I am hopeful that you might be able to use your particular forum to spread the news if you think it worthwhile.

    A leading Catholic cardinal at the Vatican has essentially said that complying the with Obama birth control mandate would have Catholics and Catholic organizations participating in sin.

    The mandate compels religious employers to pay for birth control and drugs that may cause abortions in health coverage for their employees and a revised mandate will compel them to refer employees for free coverage from their health insurance plans, which will eventually have the payment mandate.

    In an upcoming episode of Catholic Action Insight hosted by Thomas McKenna to air on EWTN on Wednesday, Cardinal Raymond Burke speaks out for the first time on the controversial mandate.

    Cardinal Burke: “Yes, I have received emails and other communications from lay faithful who say that they are supporting their bishops 100% and they have communicated to their bishops their gratitude and assured them that they want them to continue to be courageous and not to be deceived by any kind of false accommodations which in fact continue this same kind of agenda which sadly we have witnessed for too long in our country which is totally secular and therefore is anti-life and anti-family. I admire very much the courage of the bishops. At the same time I believe they would say it along with me that they are doing no more than their duty. A bishop has to protect his flock and when any individual or government attempts to force the flock to act against conscience in one of its most fundamental precepts then the bishops have to come to defend those who are entrusted to their pastoral care. So I am deeply grateful to all of the bishops who have spoken about this and who are encouraging the members of their flock to also speak up because our government needs to understand that what is being done with this mandate is contrary first of all to the fundamental human right, the right to the free exercise of one’s conscience and at the same time contrary to the very foundation of our nation.”

    Thomas McKenna: “So a Catholic employer, really getting down to it, he does not, or she does not provide this because that way they would be, in a sense, cooperating with the sin…the sin of contraception or the sin of providing a contraceptive that would abort a child, is this correct?”

    Cardinal Burke: “This is correct. It is not only a matter of what we call “material cooperation” in the sense that the employer by giving this insurance benefit is materially providing for the contraception but it is also “formal cooperation” because he is knowingly and deliberately doing this, making this available to people. There is no way to justify it. It is simply wrong.”

    Responding to the comments, Giroux says, “This comment by a high ranking Cardinal is the clearest explanation to date on the issue of an employer’s culpability when providing contraception, sterilization, and abortion inducing drug options in the insurance plans for employees.”

    “Cardinal Burke has illuminated with piercing clarity the controversial issue which has seen dissent from Church teaching on this matter among Catholic institutions and universities here in the United States,” she added.

    “There are many liberal Catholics and Obama supporters who are trying to divide and confuse the faithful on the issues surrounding this attack on religious liberty and the impending mandatory requirement for employers to provide insurance plans which provide free contraception, abortion-inducing drugs, and sterilization,” Giroux continued. “Still others that oppose the mandate are advocating that the issue of contraception should be separated from the discussion of religious liberty all together. The reality is that these issues are quite inseparable as it relates to the practice of Catholicism and the moral burden that is placed upon the conscience of employers who provide contraceptive services. Only those who understand the grave moral evil of contraception and abortion understand that the Catholic Church will never compromise on these issues because to do so would lead to eternal ramifications for those involved.”

    Organic Eden Foods’ quiet right-wing agenda
    A crunchy, natural food company marketed to liberals quietly sues to stop covering employees' contraception

    The slogan for Eden Foods, which describes itself as the “oldest natural and organic food company in North America,” is “creation and maintenance of purity in food.” Its CEO and founder, Michael Potter, has been prominent in debates over labeling of organic food and GMOs. But the company has been quietly seeking in court another form of purity — to Catholic doctrine about sex being solely for procreation. That goes not just for Potter, but for all 128 of his employees.

    That is, Eden Foods — an organic food company with no shortage of liberal customers — has quietly pursued a decidedly right-wing agenda, suing the Obama administration for exemption from the mandate to cover contraception for its employees under the Affordable Care Act. In court filings, Eden Foods, represented by the conservative Thomas More Law Center, alleges that its rights have been violated under the First Amendment, the Religious Freedom Restoration Act, and the Administrative Procedure Act. http://www.thomasmore.org/sites/defa...d%20032013.pdf

    Eden Foods, which did not respond to a request for comment, says in its filing that the company believes of birth control that “these procedures almost always involve immoral and unnatural practices.” The complaint also says that “Plaintiffs believe that Plan B and ‘ella’ can cause the death of the embryo, which is a person.” (Studies show that neither Plan B nor Ella interfere with fertilization, which is the Catholic definition of the beginning of life, if not the medical one. In other words, not the death of an embryo. Also, at that stage, it’s a zygote, not an embryo — let alone a “person.”) The filing also said that “Plaintiff Eden Foods’ products, methods, and accomplishments are described by critics as: tasteful, nutritious, wholesome, principled, unrivaled, nurturing, pure.”

    Until now, Eden Foods’ conservative advocacy litigation has remained mostly under the radar, even as their marketing seems designed to appeal to liberals, from the slogan ”Organic agriculture is society’s brightest hope for positive change” to the sixties imagery and the use of the word “revolution” in some of its print marketing. The company’s mission statement includes its goal to “contribute to peaceful evolution on earth,” “to maintain a healthy, respectful, challenging, and rewarding environment for employees,” and to “cultivate sound relationships with other organizations and individuals who are like minded and involved in like pursuits.”

    It’s not the first time a company with a nebulously progressive image has actually been led by someone whose politics would horrify many of its customers. John Mackey, the CEO of Whole Foods, has publicly campaigned against the Affordable Care Act, including recently referring to it as “fascism.” And the yoga products company’s executive adulation for Ayn Rand became famous when they printed bags asking, “Who is John Galt?” But while those companies have been raked over the coals, Eden Foods’ efforts have largely gone unnoticed.

    Eden Foods’ employees are covered under Blue Cross/Blue Shield of Michigan, but until recently, Potter was able to exclude what the insurance company deemed (hilariously) “Lifestyle Drugs.” (Some rare consistency: The exclusion also included Viagra.) But once Potter became aware that the company’s plan had begun to cover contraception in accordance with the Obamacare regulations, he teamed up with Thomas More Law Center to sue. The Center focuses on violations of “religious freedom,” including in connection with the repeal of Don’t Ask Don’t Tell. They also represented Pastor Terry Jones, who became famous for his plan to burn Korans on the anniversary of 9/11.

    They filed suit on March 20, 2013, against Secretary of Health and Human Services Kathleen Sebelius and other government parties, demanding an exemption, despite the fact that Eden Foods is a for-profit company. Two days later, District Court Judge Denise Page Hood denied an emergency motion to be exempted, writing, “Courts have held that the Mandate in question applies only to the corporate entity, not to its officers or owners, and that as to the individual owners, any burden imposed on them individually by the contraception mandate is remote[.]” She added, “The purpose of the Women’s Preventive Healthcare Regulations is not to target religion, but instead to promote public health and gender equality.” A hearing has been set for May 10.

    According to a scorecard compiled by the Becket Fund, another conservative legal outfit that has represented plaintiffs against the HHS mandate, there are 25 for-profit companies that have filed suit over the requirement to cover contraception in employee health plans. Seventeen of those have so far been granted temporary injunctions exempting them from the regulation. Separately, 30 non-profit organizations, including universities with religious affiliations, have been filed, but many are in limbo as the administration clarifies who will be exempt. This week, the public comment period on revising the regulations ended, and Planned Parenthood’s Cecile Richards said in a statement on the policy, “The idea that your employer could refuse to cover a prescription medication because they disagree with one of its uses—that’s unacceptable.”

    Many customers of Eden Foods may feel the same way about a company marketing itself to a liberal clientele and then quietly harboring a right-wing, ideological agenda.

    The REAL solution to this problem is for businesses to stop offerring health insurance as a benefit. It only started in WW II as a result of the tyrant FDR's imnposition of wage controls. Stop offering it as a benefit and let people buy their own health insurance, offering birth control as a choice to be made by the consumer. After all, leftwingers love choice...right ?

    Court rules Hobby Lobby can challenge health law, won't have to pay fines

    In a health care decision giving hope to opponents of the federal birth-control coverage mandate, a federal appeals court ruled Thursday that Hobby Lobby stores won't have to start paying millions of dollars in fines next week for not complying with the requirement.

    The 10th Circuit Court of Appeals in Denver decided the Oklahoma City-based arts and crafts chain can proceed with its case and won't be subject to fines in the meantime.

    The reprieve gives Hobby Lobby Stores Inc. more time to argue in a lower court that for-profit businesses -- not just currently exempted religious groups -- should be allowed to seek an exception if the law violates their religious beliefs. The company had sued to overturn the mandate on grounds that it violates the faith of founder and CEO David Green and his family.

    The appeals court remanded the case for more argument, but the judges indicated Hobby Lobby had a reasonable chance of success. "Sincerely religious persons could find a connection between the exercise of religion and the pursuit of profit," the judges wrote. "Would an incorporated kosher butcher really have no claim to challenge a regulation mandating non-kosher butchering practices?"

    More than 30 businesses in several states have challenged the contraception mandate. Hobby Lobby and a sister store -- Christian booksellers Mardel Inc. -- won expedited federal review because the chain would have faced fines Monday for not covering the required forms of contraception.

    The U.S. Department of Justice has argued that allowing for-profit corporations to exempt themselves from requirements that violate their religious beliefs would be in effect allowing the business to impose its religious beliefs on employees. Lawyers for the Green family called the ruling a "resounding victory for religious freedom."

    The Greens "run their business according to their Christian beliefs," said Emily Hardman, spokeswoman for the Washington-based Becket Fund for Religious Liberty, which represents Hobby Lobby.

    Americans United for Separation of Church and State said the judges were wrong to say Hobby Lobby had a case. "This court has taken a huge step toward handing bosses and company owners a blank check to meddle in the private medical decisions of their workers," executive director Barry Lynn said in a statement. "This isn't religious freedom; it's the worst kind of religious oppression."

    The 10th Circuit opted to hear the case before eight active judges, not the typical three-judge panel, indicating the case's importance.

    Hobby Lobby's lawsuit will now head back to U.S. District Court for the Western District of Oklahoma, which earlier ruled against Hobby Lobby's religious exemption request.

    Hobby Lobby calls itself a "biblically founded business" and is closed on Sundays. Founded in 1972, the company now operates more than 500 stores in 41 states and employs more than 13,000 full-time employees who are eligible for health insurance.

Catholic and other Christian individuals in the United States will now be forced by the Obama administration to buy insurance coverage that pays for sterilizations, contraceptives and abortion-inducing drugs--whether they want that coverage or not and even though it forces them to act against their faith.

    What these final adjustments to the regulation do is provide what the administration calls "accommodations" to religious non-profit organizations only--or what the regulation calls "eligible organizations." To be an "eligible organization" a group must be "a nonprofit entity" that "holds itself out as a religious organization." Organizations that certify that this is the case, however, will not be wholly liberated from providing health-insurance plans that provide access to free sterilizations, contraceptives and abortion-inducing drugs. What they will have is a convoluted relationship with their insurance company or, if they self insure, with their third-party administrator.

    According to the regulation, when a religious non-profit insures its employees through an insurance company, the insurance company will be required to provide free sterilizations, contraceptives and abortion-inducing drugs to the religious non-profit's employees free of charge.

    Theoretically, the particular health insurance plan that the religious non-profit buys from an insurance company will not itself buy these things. Instead, in theory, the insurance company providing the health insurance plan to the religious non-profit will use other money that is theoretically walled off from the premiums it received from the religious non-profit to buy the services that violate the non-profit's religious beliefs.

    Figuratively, the insurance company will take the money for the insurance premiums from the religious organization and put them in its right pocket. When the insurance company needs to pay for a sterilization procedure or an abortion-inducing drug for one of the religious organization's workers, it will take the money to pay for that out of its left pocket. When a religious non-profit self-insures, the third party administrator will either have to pay for the sterilizations, contraceptives or abortion-inducing drugs itself, or arrange for an insurance issuer to do so.

    In this scenario, the regulation says the government will compensate the third party administrator or insurance company by providing it with an accommodation in the fees it pays to the state insurance exchange. The regulation does not address the right of insurance companies or third-party administrators not to be forced by the federal government to pay for sterilizations, contraceptives and abortion-inducing drugs.

    Thus, people whose religious and moral beliefs hold that these things are immoral will be precluded from operating businesses in these industries. For example: A Catholic university could not contract with an insurance company owned by a Catholic family to provide its insurance--because the Catholic family just like the Catholic university would be prevented by its faith from paying for sterilizations, contraceptives and abortion-inducing drugs. Under the final regulation, the insurance company for a Catholic university will be forced to pay for sterilizations, contraceptives and abortion-inducing drugs.

    Catholic non-profits, under the final regulation, will be forced to patronize for-profit businesses that have no problem with killing unborn children. The only people left in America who would be able to operate health insurance companies and third-party administrators would be those people ready and willing to pay for abortion-inducing drugs.

    Individual Americans and privately owned companies, including family-owned companies, are given no accommodation at all in the final regulation. Individuals must buy insurance that covers sterilizations, contraceptives and abortion-inducing drugs. Privately owned for-profit businesses that provide insurance to their workers must covers these things--even if they believe paying for and providing such things is immoral and against the teachings of their faith.

    The First Amendment says Congress can make no law "prohibiting the free exercise" of religion. The Obama administration now says to Catholics and other Christians who oppose sterilization, contraception and/or abortion: You are not free to exercise your faith. You must act against its teachings. You must do what we say, not what your conscience says.

    When my family and I started our company 40 years ago, we were working out of a garage on a $600 bank loan, assembling miniature picture frames. Our first retail store wasn’t much bigger than most people’s living rooms, but we had faith that we would succeed if we lived and worked according to God’s word.

    From there, Hobby Lobby has become one of the nation’s largest arts and crafts retailers, with more than 500 locations in 41 states. Our children grew up into fine business leaders, and today we run Hobby Lobby together, as a family.

    We’re Christians, and we run our business on Christian principles. I’ve always said that the first two goals of our business are (1) to run our business in harmony with God’s laws, and (2) to focus on people more than money. And that’s what we’ve tried to do. We close early so our employees can see their families at night. We keep our stores closed on Sundays, one of the week’s biggest shopping days, so that our workers and their families can enjoy a day of rest.

    We believe that it is by God’s grace that Hobby Lobby has endured, and he has blessed us and our employees. We’ve not only added jobs in a weak economy, we’ve raised wages for the past four years in a row. Our full-time employees start at 80% above minimum wage.

    But now, our government threatens to change all of that.

    A new government healthcare mandate says that our family business MUST provide what I believe are abortion-causing drugs as part of our health insurance. Being Christians, we don’t pay for drugs that might cause abortions, which means that we don’t cover emergency contraception, the morning-after pill or the week-after pill. We believe doing so might end a life after the moment of conception, something that is contrary to our most important beliefs.

    It goes against the Biblical principles on which we have run this company since day one.

    If we refuse to comply, we could face $1.3 million PER DAY in government fines.

    Our government threatens to fine job creators in a bad economy.

    Our government threatens to fine a company that’s raised wages four years running.

    Our government threatens to fine a family for running its business according to its beliefs. It’s not right. I know people will say we ought to follow the rules; that it’s the same for everybody. But that’s not true.

    The government has exempted thousands of companies from this mandate, for reasons of convenience or cost. But it won’t exempt them for reasons of religious belief.

    So, Hobby Lobby and my family are forced to make a choice. With great reluctance, we filed a lawsuit today, represented by the Becket Fund for Religious Liberty, asking a federal court to stop this mandate before it hurts our business. We don’t like to go running into court, but we no longer have a choice. We believe people are more important than the bottom line and that honoring God is more important than turning a profit.

    My family has lived the American dream. We want to continue growing our company and providing great jobs for thousands of employees, but the government is going to make that much more difficult.

    The government is forcing us to choose between following our faith and following the law. I say that’s a choice no American and no American business should have to make.

    The government cannot force you to follow laws that go against your fundamental religious belief. They have exempted thousands of companies but will not except Christian organizations including the Catholic church.

    You can say the sperm has not reached the egg in one to five days if you like. You go ahead and tell that line to God on Judgement Day. Those who are righteous will receive rewards and those who are not will get what our Father deems they deserve.

    In addition, the issue is government is forcing him to do something that is against his beliefs. They are violating his first amendment right by prohibiting the exercise of his religion.

    Amendment I

    Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
    The words, "separation of church and state" appear no where in the Constitution. All the first amendment is stating is there cannot be a government sanctioned religion. Pull out a coin from your pocket, this nation was founded on Christianity, "In God We Trust."

    Our country is already in bad shape due to the rampid sin and decline in moral values. It is even more disgusting that our so called government is imposing such rules and decisions on Americans. Our President is determined to bring this country down and I feel.sorry for.him and all of.his followers when.they.have to face the Lord one day. It will be very sad for all of.us if you have to shut down.your stores, very sad.

    Hobby Lobby, as a family owned company, can and should run THEIR business according their faith in Jesus. This would be a very difficult choice for the Green family without a doubt. I would miss Hobby Lobby, but would support this company 100% for standing up for what they believe in and not bowing down to what the government and or some people think they should.

    Something to think about...

    When the Catholic Church was founded, there were no hospitals. Today, one out of five people in this country receive their medical care at a Catholic hospital.

    When the Catholic Church was founded, there were no schools. Today, the Catholic Church teaches 3 million students a day, in its more than 250 Catholic Colleges and Universities, in its more than 1200 Catholic High Schools and its more than 5000 Catholic grade schools in this country.

    Everyday, the Catholic Church feeds, clothes, shelters and educates more people than any other organization in the world.

    Also, all Catholic adoption services would come to an end; a human disaster.

    The new Obama Health Mandate could end all this and **we** tax payers would have to make up the loss.

    There are more than 77 million Catholics in this country. It takes an estimated 50 million Catholic votes to elect a president. I am asking all of you to go to the polls in 2014 and be united in replacing all Senators and Representatives with someone who will respect the Catholic Church; all Christians and all Religions and not make an exception of Islam.

    Mr. President, you said, "The USA is not a Christian Nation". You are wrong! We are a Christian Nation founded on Judeo-Christian values
    allowing **all** religions in America to Worship & Practice Freely. Something Islam will never do.

    Oh, by the way, on MUSLIM HERITAGE IN America ...

    Have you ever been to a Muslim hospital?

    Have you heard a Muslim orchestra?

    Have you seen a Muslim band march in a parade?

    Obama Administration: We Can and Will Force Christians to Act Against Their Faith

    (CNSNews.com) - In a legal argument formally presented in federal court in the case of Hobby Lobby v. Kathleen Sebelius, the Obama administration is claiming that the First Amendment—which expressly denies the government the authority to prohibit the “free exercise” of religion—nonetheless allows it to force Christians to directly violate their religious beliefs even on a matter that involves the life and death of innocent human beings.

    Because federal judges—including Supreme Court Justice Sonia Sotomayor—have refused to grant an injunction protecting the owners of Hobby Lobby from being forced to act against their Christian faith, those owners will be subject to federal fines of up to $1.3 million per day starting Tuesday for refusing to include abortion-inducing drugs in their employee health plan.

    The Obama administration is making a two-fold argument for why it can force Christians to act against their faith in complying with the regulation it has issued under the Obamacare law that requires virtually all health care plans to cover, without co-pay, sterilizations, contraceptives, and abortion-inducing drugs.

    The first argument the administration makes against the owners of Hobby Lobby is that Americans lose their First Amendment right to freely exercise their religion when they form a corporation and engage in commerce. A person’s Christianity, the administration argues, cannot be carried out through activities he engages in through an incorporated business. “Hobby Lobby is a for-profit, secular employer, and a secular entity by definition does not exercise religion,” said Acting Assistant Attorney General Stuart Delery in a filing submitted in the U.S. District Court for the Western District of Oklahoma.

    “Because Hobby Lobby is a secular employer, it is not entitled to the protections of the Free Exercise Clause or RFRA [the Religious Freedom Restoration Act],” Delery told the court on behalf of the administration. “This is because, although the First Amendment freedoms of speech and association are ‘right[s] enjoyed by religious and secular groups alike,’ the Free Exercise Clause ‘gives special solicitude to the rights of religious organizations.’”

    In keeping with Delery’s argument, the Washington Post, as a corporation, can use its First Amendment-protected freedom of speech to write editorials in support of the Obama administration imposing its contraception mandate on businesses like Hobby Lobby. But the members of the family that created and owns Hobby Lobby, because they formed Hobby Lobby as a corporation, have no First Amendment freedom of religion that protects them from being forced by the government to act against their religious beliefs in providing abortion-inducing drugs.

    The second argument the administration makes to justify forcing Christians to act against their faith is more sweeping. Here the administration argues it can force a person to act against his religion so long as the coercion is done under the authority of a law that is neutral and generally applicable—in other words, as long as the law was not written specifically to persecute Christians as Christians, the government can use that law to persecute Christians.

    Hobby Lobby is a family business. David Green created it in his garage in Oklahoma City in 1972. He and his wife, Barbara, and their three children—Steve, Mart and Darsee Green Lett-- have grown the business to where it now operates 500 stores in 41 states. David Green is Hobby Lobby’s CEO; Steve Green is its president; Mart Green is vice CEO; and Darsee Lett is vice president. Mart Green is also CEO of the privately owned Mardel chain of Christian bookstores, which operates 35 stores in 7 states. Through Hobby Lobby, the Greens have created more than 13,000 jobs. Mardel has created 372 jobs.

    The Greens, who are Evangelical Christians, do not suspend their religious beliefs while running their businesses. Instead, they strive to run them fully in accordance with their Christian beliefs. They are unanimous in stating that they have always “sought to run Hobby Lobby in harmony with God’s laws and in a manner which brings glory to God.” They do not have two sets of morals—one for when they are at church or at home and another for when they are working on their businesses. They have only one set of morals—that they strive to follow at work or any other activity. For example, they close their business on Sundays, so their employees can spend that day with their families, and they pay their full-time workers a minimum hourly wage of $13, which is far exceeds the federal minimum wage.

    They also provide their employees with a generous self-insured health care plan, and they even operate an on-site, cost-free health clinic at their corporate headquarters. But, guided by their Christian faith, the Greens believe that human life begins at conception and that aborting on unborn life is wrong. In keeping with this, they do not cover in their employee health plan abortions, abortion-inducing drugs or IUDs that prevent implantation of an embryo.

    Unlike Catholics, the Greens do not believe that contraception and sterilization are morally wrong.

    In September, the Greens, Hobby Lobby and Mardel bookstores sued Health and Human Services Secretary Kathleen Sebelius, Labor Secretary Hilda Solis, Treasury Secretary Timothy Geithner and the departments of Health Human Service, Labor and Treasury. Their complaint said that the Obamacare contraception mandate violates their First Amendment right to the free exercise of religion because supporting abortion or counseling for abortion is contrary to their religious faith.

    As the mandate now stands, the Greens must begin complying with it on Jan. 1. On Nov. 11, U.S. District Judge Joe Heaton refused to grant a preliminary injunction to stop the mandate from being enforced on the Greens while the court decided their case on its merits. In his ruling on the injunction, Judge Heaton determined that the Greens were not likely to establish they had a right to “free exercise” of religion while operating Hobby Lobby.

    ‘[T]he court concludes plaintiffs have not established a likelihood of success as to their constitutional claims,” said Judge Heaton. “The corporations lack free exercise rights subject to being violated and, as the challenged statutes/regulations are neutral and of general applicability as contemplated by the constitutional standard, plaintiffs are unlikely to successfully establish a constitutional violation in any event.”

    The Greens appealed their request for an injunction to the U.S. Court of Appeals for the 10th Circuit. A panel of two appeals court judges refused their plea. They then appealed to Supreme Court Justice Sonia Sotomayor, who sits over that circuit, and she declined to reverse the lower courts and issue an injunction.

    When Sotomayor ruled against a preliminary injunction on Thursday, the Becket Fund for Religious Liberty, which is representing the Greens, issued a statement indicating that the Greens would not start complying with the mandate on Tuesday and that they would continue to pursue their case in federal court.

    “Hobby Lobby will continue their appeal before the Tenth Circuit,” said Becket Fund General Counsel Kyle Duncan. “The Supreme Court merely decided not to get involved in the case at this time. It left open the possibility of review after their appeal is completed in the Tenth Circuit. The company will continue to provide health insurance to all qualified employees. To remain true to their faith, it is not their intention, as a company, to pay for abortion-inducing drugs.”

    As the nation approaches the much publicized fiscal cliff, it also approaches a moral cliff: Will the Obama administration compel Christians to act against their faith? As of now, the answer seems plain: Starting Tuesday, it will.

    as long as the law was not written specifically to persecute Christians as Christians, the government can use that law to persecute Christians.
    Freedom of religion is dead in the USA if Hobby Lobby loses.
