    Federal Appeals Court blocks Obama from forcing Catholics to pay for abortions

    A powerful federal appeals court ruled today that a Catholic family-run business does not have to comply with the Obamacare abortion mandate requiring it to pay for birth control and drugs that may cause abortions.

    Francis A. Gilardi, Jr. and Philip M. Gilardi, two brothers who own and control two companies that are involved in the processing, packaging, and transportation of fresh produce, filed suit against the Obama administration on behalf of their business, Freshway Foods, a nearly 25 year old family-owned fresh produce processor and packer, which serves 23 states and has 340 full-time employees.

    Both companies are located in Sidney, Ohio, a city in west-central Ohio located about 40 miles north of Dayton. The owners, who are Catholic, contend that the HHS mandate requiring coverage for contraception, sterilization, and abortion-inducing drugs – violates their religious beliefs.

    The D.C. Circuit Court of Appeals — the second most influential bench in the land behind the Supreme Court — ruled in favor of the brothers. Requiring companies to cover their employees’ contraception, the court ruled, is unduly burdensome for business owners who oppose birth control and abortion on religious grounds. “The burden on religious exercise does not occur at the point of contraceptive purchase; instead, it occurs when a company’s owners fill the basket of goods and services that constitute a healthcare plan,” Judge Janice Rogers Brown wrote on behalf of the court.

    Let's take it further.... Why should I have to pay for or supplement, my 500+ pound sister? She has high blood pressure, diabetes, arthritis, joint problems, fatty tumors etc. All because she cannot keep oreos and chips out of her mouth. She refuses to exercise besides walking to and from her car. That is the problem with the ACA. I am overweight myself but I also do not suffer from obese ailments because I try to eat healthy and exercise. The doctors and nurses are always shocked that my numbers are so good. Perfect was the word he used. I am not a drug user but I should not have to pay higher premiums so those who are can afford healthcare.

    The federal government has paid tens of millions of dollars in Medicare benefits to dead people and illegal immigrants, according to a pair of reports from federal watchdogs released on Thursday.

    The Department of Health and Human Services’ Centers for Medicare and Medicaid Services paid out $23 million to beneficiaries after their deaths in 2011, according to one report from HHS’ inspector general.

    Another report tallied more than $28 million in payments from 2009 to 2011 to individuals who were in the country illegally.

    In all, CMS paid Medicare benefits to 4,139 illegal immigrants and 17,403 deceased people, according to the two reports.

    Federal regulations prohibit illegal immigrants from receiving Medicare benefits. CMS has policies in place to prevent people who are unlawfully present from receiving benefits under Medicare Parts A and B, but no such protections for Medicare Part D benefits.

    Catholic Bishops: We will not comply with the HHS abortion mandate

    The nation’s Catholic bishops have a message for President Barack Obama: They would rather pay fines, no matter how much they would be, before they comply with the HHS mandate that compels groups to pay for birth control and drugs that may cause abortions.

    The U.S. Conference of Catholic Bishops today issued a “Special Message” at the conclusion of their fall General Assembly, November 13, in Baltimore. They unanimously passed the special message, which can only be issued as such meetings and strongly condemned the HHS mandate.

    They said that, with its “coercive mandate,” the Obama administration “is refusing to uphold its obligation to respect the rights of religious believers.”

    “Beginning in March 2012, in United for Religious Freedom, we identified three basic problems with the HHS mandate: it establishes a false architecture of religious liberty that excludes our ministries and so reduces freedom of religion to freedom of worship; it compels our ministries to participate in providing employees with abortifacient drugs and devices, sterilization, and contraception, which violates our deeply-held beliefs; and it compels our faithful people in business to act against our teachings, failing to provide them any exemption at all,” they said.

    “Despite our repeated efforts to work and dialogue toward a solution, those problems remain. Not only does the mandate undermine our ministries’ ability to witness to our faith, which is their core mission, but the penalties it imposes also lay a great burden on those ministries, threatening their very ability to survive and to serve the many who rely on their care,” the bishops added.

    “As the government’s implementation of the mandate against us approaches, we bishops stand united in our resolve to resist this heavy burden and protect our religious freedom,” they said. “We will continue our efforts in Congress and especially with the promising initiatives in the courts to protect the religious freedom that ensures our ability to fulfill the Gospel by serving the common good.”

It was literally idolatry.

    The Greens and their family businesses – who have no moral objection to providing 16 of the 20 FDA-approved contraceptives required under the HHS mandate and do so at no additional cost to employees under their self-insured health plan – then took the unusual step in October of joining the government in asking the U.S. Supreme Court to review the case, despite the family’s victory in the U.S. Tenth Circuit Court of Appeals.
    So the issue here isn’t the Greens’ refusal to provide employees with birth control. What Democrats have a problem with is that the Greens aren’t willing to compromise their faith in order to bend to the will of the government, which, by the way, should play no role in health care in the first place.

    Sharyl Attkisson uncovered another Obama administration falsehood about ObamaCare on Tuesday's CBS This Morning, spotlighting a 2010 document from the Centers for Medicare and Medicaid Services which "estimated ObamaCare would collectively reduce the number of people with employer-sponsored health coverage by about 14 million". This is contrary to the White House's "repeated assurances that nothing will change for those insured through work".

    Attkisson featured the cases of two small business owners who had to discontinue the health insurance plans for their employees, including a New Hampshire woman who "remains an avid ObamaCare supporter", despite the problems with HealthCare.gov.     Anchor Norah O'Donnell teased the correspondent's report by trumpeting how "employees [are] losing their current company health benefits because of the Affordable Care Act – Sharyl Attkisson investigates what the government knew was coming." Minutes later, co-anchor Charlie Rose introduced the segment by noting that "CBS News is learning another promise by the government isn't holding up. Some of those who get their insurance through work are losing their coverage."

    The CBS journalist continued that "the government estimated all along that millions of workers will be dropped from their employee insurance under the Affordable Care Act. And for some, it's already happening."     Planned Parenthood, NARAL, NOW, the ACLU, Americans United for Separation of Church and State, Secular Coalition for America and several “reproductive rights” student groups were bussed in from within D.C. and even as far as New York for the rally Tuesday morning.

    Some of the more interesting signs: “Eating raped murdered animals makes you a hypocrite,” “Get out of my box [ie: vagina],” “This [a Bible] is not a health care plan,” “Who’s the boss? Me!” and “Sex is beautiful, reproduction is optional.”

    Activists also chanted “Si Se puede!” (Yes we can), the Cesar Chavez slogan that Obama co-opted, many different times throughout the rally. “We are the 99 Percent!” from Occupy Wall Street, was also co-opted for the pro-choice movement, citing a statistic from the CDC erroneously. Leftist politics were obviously well represented.

    This 99 percent statistic isn’t even what the pro-choice crowd think it means. The statistic is from the CDC, which said in 2013, “More than 99% of women aged 15–44 who have ever had sexual intercourse have used at least one contraceptive method.” However, the pro-choice movement twisted this finding to say that 99 percent of all women use all types of artificial contraception on a regular basis, including contraception such as Plan B or “the morning-after pill” which many religious and otherwise pro-life people object to, as ending human life.

    Of course the standard, “Get out of my uterus” and “trust women to do what they want with their own bodies” rhetoric was reiterated dozens of times through speakers and signs.

    The pro-choice activists message was clear: Hobby Lobby’s refusal to pay for something its management opposes on religious grounds – and which it was not required to provide until Obamacare was enacted – is an attack against all women in general, and their ability to get any type of contraception.

    Of course, it’s a dishonest argument. Hobby Lobby’s employees are free to go out and purchase abortifacients with their own money. What the left is really defending is a new entitlement to “free” birth control.

    What’s more is that they know it, organized the protest to rely on their numbers, flashy and simplistic signs, vague chants and a compliant media to parrot the bogus “War on Women” rhetoric. This loud and abrasive group went oddly silent when asked factual questions. Culture and Media Institute reporter Katie Yoder attempted to interview several protestors from pro-choice groups such as NARAL and Planned Parenthood, but few would speak to her.

    In stark contrast to the yelling and chanting of left-wing mantras and bankrupt slogans, and the signs dismissing the Bible, a simultaneous pro-life rally stood peacefully off to the side, heads bowed and praying.
