    Senate votes 100 - 0 to avert government shutdown

    The Senate will vote to move ahead with a bill to keep the government running through Nov. 15.

    WASHINGTON — The U.S. Senate voted 100-0 Wednesday to clear a key procedural hurdle toward passing a stopgap funding bill to avert a government shutdown in six days. The vote occurred after a dramatic overnight floor speech by Sen. Ted Cruz, R-Texas, and his allies who waged a filibuster-styled effort in opposition to President Obama's health care law.

    This afternoon's vote cleared the way to begin debate on a House-passed stopgap spending bill that includes language to defund the Affordable Care Act. Senate Majority Leader Harry Reid, D-Nev., is expected to strip that provision fom the bill and return to the House later this week a clean stopgap measure to keep the government funded through Nov. 15. "Every hour we delay here, we move closer to shutting down our government," Reid said after the vote.

    The overwhelming support for the procedural vote made clear that the votes do not exist in Congress to defund the law, but Cruz's filibuster-style speech drew praise from colleagues and opponents of the law. Cruz held the floor for more than 21 hours, yielding only for questions from supportive Republican senators. In the end, even Cruz voted to end debate.

    "Americans owe Sen. Ted Cruz a debt of gratitude for standing on principle in the fight to stop 'Obamacare,'" the conservative anti-tax Club for Growth President Chris Chocola said. "The Washington elite is in complete denial, but here are the facts: Obamacare is a disaster, it is one of the biggest assaults on individual liberty in history, it is stifling economic growth, and it will not work."

    House Speaker John Boehner, R-Ohio, will have three options once the Senate volleys back the spending bill: reject it, approve it or amend it and send it back to the Senate with little more than 24 hours before a shutdown takes place. The House canceled a scheduled recess this week to return to Washington today. Boehner has not said how the House will respond.

    Sens. John McCain, R-Ariz., and Lindsey Graham, R-S.C., have advocated for attaching to the spending bill a repeal of the 2.3% tax on medical devices enacted as part of the ACA to help pay for its implementation. A non-binding amendment to the Senate budget resolution this year drew 79 votes in support of repealing the tax.

    Congress is expected to be in session through the weekend to try to resolve the impasse.

    There is broad GOP opposition to the health care law, and congressional Republicans are using two impending budget votes to attempt to dismantle Obamacare, which begins open enrollment on Oct. 1. However, President Obama has vowed to veto any legislation that delays or defunds his signature domestic achievement, and his Democratic allies in the Senate stand to reject any bill the House sends over to that end.

    Treasury Secretary Jack Lew reminded Congress on Wednesday that the second budget battle looms in just three weeks, advising lawmakers the United States will hit its borrowing limit no later than Oct. 17.

    Raising the debt ceiling requires a vote of congressional approval. Failing to raise the debt ceiling would result in the U.S. defaulting on its debt payments for the first time in history.

    White House spokesman Jay Carney said Obama will likely talk with congressional leaders in the days ahead, but no specific meeting has been set.

    "It would be irresponsible not to fund the essential functions of government out of ideological pique," Carney said.

    While Obama is willing to discuss ways to forge a new spending plan, Carney repeated that the president would not negotiate over the debt ceiling; raising that limit will enable the government to pay bills in has already incurred, the spokesman said.

    Otherwise, he said, the government will default on debts, damaging the national and global economy.

    "The debt ceiling must be raised," Carney said. "This cannot and should not be a matter of negotiation."

    White House Chief of Staff Denis McDonough will go to Capitol Hill later today to meet with House Democrats on the budget.

    Rep. Peter Welch, D-Vt., said 186 House Democrats had signed a letter he authored in support of raising the debt ceiling without conditions.

    House GOP leaders are preparing a legislative package tied to a debt ceiling that could get a vote as early as next week. House Republicans will meet Thursday morning where leadership will brief their rank-and-file morning on their proposed debt ceiling package.

    In exchange for suspending the debt ceiling through 2014 and past the midterm elections, Republicans are seeking a one-year delay in the opening of the requirement that uninsured people buy health insurance through a series of state health care exchanges. They are scheduled to go online Oct. 1. Other parts of the law have been in effect since 2010.

    In addition, Republican leaders are expected to include in the package instructions for an overhaul of the federal tax code, authorization of the controversial Keystone XL oil pipeline, as well as a list of popular GOP economic provisions to reduce environmental and small business regulations, among others. The package is also expected to include budget savings achieved through changes in mandatory Medicare spending and reductions in the Dodd Frank financial overhaul law.

    Obama and congressional Democrats have vowed not to negotiate on the debt ceiling, but Republicans believe they hold some leverage in the budget debate because of the keen interest among leading Democrats — including Senate Appropriations Chairwoman Barbara Mikulski and Reid — to reach an agreement to turn off the unpopular, across-the-board budget cuts known as the sequester, for up to two years.

    WASHINGTON (AP) — A government shutdown would have far-reaching consequences for some, but minimal impact on others.

    Mail would be delivered. Social Security and Medicare benefits would continue to flow. But vacationers would be turned away from national parks and Smithsonian museums. Low-to-moderate income borrowers and first-time homebuyers seeking government-backed mortgages could face delays.

    A look at how services would or would not be affected if Congress fails to reach an agreement averting a government shutdown at midnight Monday.

    AIR TRAVEL : Federal air traffic controllers would remain on the job and airport screeners would keep funneling passengers through security checkpoints. Federal inspectors would continue enforcing safety rules.

    INTERNATIONAL TRAVEL : The State Department would continue processing foreign applications for visas and U.S. applications for passports, since fees are collected to finance those services. Embassies and consulates overseas would continue to provide services to American citizens.

    BENEFIT PAYMENTS : Social Security and Medicare benefits would keep coming, but there could be delays in processing new disability applications. Unemployment benefits would still go out.

    FEDERAL COURTS : Federal courts would continue operating normally for about 10 business days after the start of a shutdown, roughly until the middle of October. If the shutdown continues, the judiciary would have to begin furloughs of employees whose work is not considered essential. But cases would continue to be heard.

    MAIL : Deliveries would continue as usual because the U.S. Postal Service receives no tax dollars for day-to-day operations. It relies on income from stamps and other postal fees to keep running.

    RECREATION : All national parks would be closed, as would the Smithsonian museums, including the National Zoo in Washington. Visitors using overnight campgrounds or other park facilities would be given 48 hours to make alternate arrangements and leave the park. Among the visitor centers that would be closed: the Statue of Liberty and Ellis Island in New York, Independence Hall in Philadelphia, Alcatraz Island near San Francisco and the Washington Monument.

    HEALTH : New patients would not be accepted into clinical research at the National Institutes of Health, but current patients would continue to receive care. Medical research at the NIH would be disrupted and some studies would be delayed. The Centers for Disease Control and Prevention would be severely limited in spotting or investigating disease outbreaks, from flu to that mysterious MERS virus from the Middle East.

    FOOD SAFETY : The Food and Drug Administration would handle high-risk recalls suspend most routine safety inspections. Federal meat inspections would be expected to proceed as usual.

    HEAD START : A small number of Head Start programs, about 20 out of 1,600 nationally, would feel the impact right away. The federal Administration for Children and Families says grants expiring about Oct. 1 would not be renewed. Over time more programs would be affected. Several of the Head Start programs that would immediately feel the pinch are in Florida. It's unclear if they would continue serving children.

    FOOD ASSISTANCE : The Special Supplemental Nutrition Program for Women, Infants and Children, known as WIC, could shut down. The program provides supplemental food, health care referrals and nutrition education for pregnant women, mothers and their children.

    School lunches and breakfasts would continue to be served, and food stamps, known as the Supplemental Nutrition Assistance Program, or SNAP, would continue to be distributed. But several smaller feeding programs would not have the money to operate.

    TAXES : Americans would still have to pay their taxes and file federal tax returns, but the Internal Revenue Service says it would suspend all audits. Got questions? Sorry, the IRS says taxpayer services, including toll-free help lines, would be shut as well.

    LOANS : Many low-to-moderate incomes borrowers and first-time homebuyers seeking government-backed mortgages could face delays during the shutdown. The Federal Housing Administration, which guarantees about 30 percent of home mortgages, wouldn't underwrite or approve any new loans during the shutdown. Action on government-backed loans to small businesses would be suspended.

    SCIENCE : NASA will continue to keep workers at Mission Control in Houston and elsewhere to support the International Space station, where two Americans and four others are deployed. The National Weather Service would keep forecasting weather and issuing warnings and the National Hurricane Center would continue to track storms. The scientific work of the U.S. Geological Survey would be halted.

    HOMELAND SECURITY : The majority of the Department of Homeland Security's employees are expected to stay on the job, including uniformed agents and officers at the country's borders and ports of entry, members of the Coast Guard, Transportation Security Administration officers, Secret Service personnel and other law enforcement agents and officers. U.S. Citizenship and Immigration Services employees would continue to process green card applications.

    MILITARY : The military's 1.4 million active duty personnel would stay on duty, but their paychecks would be delayed. About half of the Defense Department's civilian employees would be furloughed.

    PRISONS : All 116 federal prisons would remain open, and criminal litigation would proceed.

    VETERANS SERVICES : Most services offered through the Department of Veterans Affairs will continue because lawmakers approve money one year in advance for the VA's health programs. Veterans would still be able to visit hospitals for inpatient care, get mental health counseling at vet centers or get prescriptions filled at VA health clinics. Operators would still staff the crisis hotline and claims workers would still process payments to cover disability and pension benefits. But those veterans appealing the denial of disability benefits to the Board of Veterans Appeals will have to wait longer for a decision because the board would not issue any decisions during a shutdown.

    WORK SAFETY : Federal occupational safety and health inspectors would stop workplace inspections except in cases of imminent danger.

    The federal government officially shut down for the first time in 17 years at midnight on Monday, after House Republicans refused to drop demands that parts of the Affordable Care Act be delayed in return for approval of a mandatory government funding bill.

    Federal employees who are considered essential to public safety will be expected to work this week. But most federal offices will be closed until Congress reaches a deal. The shutdown is the first one of its kind since 1996, when the government closed for 26 days under President Bill Clinton.

    Despite missing the deadline, debate persisted in the House and Senate early into the morning. The House is still planning to request to establish a conference committee with the Senate, but Senate Democratic leaders preemptively rejected the offer Monday night, saying they would not negotiate until the House had passed a bill to fund the government for six weeks without any extra provisions.

    The Senate will likely respond by tabling the offer, which will take the federal government into a partial shutdown scenario beginning Tuesday morning.

    House Republican leaders intend to request a conference committee from Senate Democrats to resolve differences on a bill to fund the government. But earlier Monday, Senate Democrats announced they would reject a House request for a conference committee to find a solution to budget woes. "Republicans are still playing games," Senate Majority Leader Harry Reid, a Democrat of Nevada said on the House floor.

    Appointing a conference committee would not have averted a government shutdown before the Monday night deadline when government funding levels expire, but it could have put the battling parties in a position to reach an agreement to fund the government faster than the game of legislative ping pong House Republicans played with Senate Democrats on the final day before the shutdown deadline.

    Over the past week, the Senate rejected the third proposal from the House to keep the government open while also attacking Obamacare — most recently by delaying the individual mandate to buy health insurance and by prohibiting congressional staff members from federal insurance subsidies under the controversial health care program.

    As time grew short, President Barack Obama signed last-minute legislation to ensure that members of the military and personnel at the Department of Homeland Security get paid even in the event of a shutdown. And aides scoffed at the conference request as a desperate gambit ensuring that government will turn out the lights at midnight. Obama, after stepping before cameras to urge an end to the standoff, reached out by telephone to Republican House Speaker John Boehner, Democratic Senate Majority Leader Harry Reid, Democratic House Minority Leader Nancy Pelosi and Republican Senate Minority Leader Mitch McConnell ― but there was no breakthrough, a White House official said.

    As a result of Republicans refusing to hold a budget conference to set spending levels for the year, Congress is funding the government with short-term, stop-gap "continuing resolutions" that must be approved when old ones expire. The deadline for approving a new one is midnight Monday. Earlier this month, House Republicans passed their first version of a spending bill but added a controversial amendment that would defund Obamacare. After a lengthy debate over the bill in the Democrat-controlled Senate, which included a 21-hour protest speech from Texas Republican Sen. Ted Cruz, the upper chamber rejected the House bill and returned its version with the Obamacare funding reinserted.
    Senate Democratic leaders warned that they would accept nothing short of a “clean” continuation of funding — one without riders such as defunding Obamacare — a move that practically dared Republicans to blink.

    House Republicans only dug in their heels deeper. Over the weekend, they approved another bill, one that would delay Obamacare for a year and permanently abolish a tax on medical devices, and the Senate rejected it Monday.

    Boehner, Republican of Ohio, chided Senate Democrats Monday for waiting until the day before a shutdown to act and reiterated the House’s intention to use the shutdown battle as a vessel to cripple the health care law. "This law is not ready for prime time. The House has done its work,” Boehner said on the House floor. “It's time for the Senate to listen to the American people just like the House has listened to the American people and pass a one-year delay of Obamacare."

    Obama, who has vowed to veto any spending bill that tampers with the Affordable Care Act, said Monday that he was not "resigned" to a shutdown. “I suspect I will be speaking to the leaders today, tomorrow and the next day," Obama said.

    Before the House chose to attack Obamacare using the mandatory spending bill, House Republicans had planned instead to use an upcoming vote to raise the federal government’s debt limit as the vehicle for delaying the law. However, with support from Cruz and his allies in the Senate, House conservatives demanded action immediately. Boehner relented, Democrats refused to budge and the federal government shut down.

    The OMB pulled the plug on the United States government a few minutes before midnight, plunging the nation into what’s being called #Shutnado. The effects were immediate in many cases, with websites like the USDA disappearing at midnight. But how were civilians affected? Without the benefit of Michelle Obama’s #DrinkH2O tweets, poor Dana Loesch developed a drinking problem.
