    National ‘assault weapon’ ban coming Thursday

    Sen. Dianne Feinstein’s office confirmed that she will be introducing in the Senate Thursday a new version of the so-called assault weapon ban. A spokesman said the full text will be released at a press conference on Thursday.

    The California Democrat intends to expand on the ban that expired in 2004, by including handguns and shotguns, in addition to rifles. She would decrease from two to one the number of cosmetic features on a gun to have it be considered an “assault weapon.” This means that if a gun has just one item like a pistol grip or bayonet lug, then it is illegal. Gov. Andrew Cuomo signed into law the same ban in New York last week.

    Furthermore, instead of grandfathering in current firearms, she would create a national gun registry for the government to track lawful gun owners. Magazines would again be limited to 10 rounds.

    The Clinton-era bill was not renewed by Congress after the Federal Bureau of Investigation and law enforcement agencies reported that it was ineffective in reducing crime.

    President Obama said that a top priority is to get “an assault weapons ban that is meaningful” passed this year.

    A summary of Mrs. Feinstein’s legislation is below.

    Bans the sale, transfer, importation, or manufacturing of: 120 specifically-named firearms; certain other semiautomatic rifles, handguns, shotguns that can accept a detachable magazine and have one or more military characteristics; and semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds.

    Strengthens the 1994 Assault Weapons Ban and various state bans by: Moving from a 2-characteristic test to a 1-characteristic test; eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test; and banning firearms with “thumbhole stocks” and “bullet buttons” to address attempts to “work around” prior bans.

    Bans large-capacity ammunition feeding devices capable of accepting more than 10 rounds.

    Protects legitimate hunters and the rights of existing gun owners by: Grandfathering weapons legally possessed on the date of enactment; exempting over 900 specifically-named weapons used for hunting or sporting purposes; and exempting antique, manually-operated, and permanently disabled weapons.

    Requires that grandfathered weapons be registered under the National Firearms Act, to include: Background check of owner and any transferee; type and serial number of the firearm; positive identification, including photograph and fingerprint; certification from local law enforcement of identity and that possession would not violate State or local law; and dedicated funding for ATF to implement registration.

    A retooled U.S. assault-weapons ban to be introduced Thursday was to include handguns and shotguns in addition to rifles, The Washington Times reported. The bill, by Sen. Dianne Feinstein, D-Calif., titled "The Assault Weapons Ban of 2013," was also expected to decrease the number of military-style features a gun may have before it's considered an assault weapon to one from two, the newspaper said.

    An assault weapon is typically a semiautomatic firearm having features similar to those of a military firearm. Military-style features include pistol grips, flash suppressors, bayonet lugs or grenade launchers.

    New York Gov. Andrew Cuomo signed into law a ban similar to Feinstein's proposed ban last week.

    National Rifle Association President David Keene said Wednesday New York's bolstered ban on assault weapons was likely unconstitutional and his organization planned to file a "notice of claim" against the state -- the first step toward a possible lawsuit. "A so-called assault-weapons ban in today's world is probably unconstitutional," Keene told radio station WGDJ, Rensselaer, N.Y., citing the U.S. Supreme Court's 2008 ruling in District of Columbia vs. Heller, which he said prevents the government from banning "commonly used firearms."

    Associate Justice Antonin Scalia's opinion for the majority provided Second Amendment protection for commonly used and popular handguns, but not for atypical arms or arms used for unlawful purposes, such as sawed-off shotguns.

    Feinstein's bill would also create a national gun registry for the government to track lawful gun owners, the Times said.

    Magazines, or ammunition storage and feeding devices within or attached to a repeating firearm, would be limited to 10 rounds, the newspaper said.

    The Sandy Hook Elementary School shooting in Newtown, Conn., was to provide the backdrop for the Feinstein bill as Democratic Sens. Richard Blumenthal and Chris Murphy of Connecticut, as well as Democratic Rep. Elizabeth Esty, whose district includes Newtown, were to join Feinstein, officials said. Twenty students and six staff members at the elementary school were killed with an assault weapon.

    Blumenthal told Hearst Newspapers the new bill would "be a more stringent measure than the assault weapon ban that existed from 1994 to 2004." He said the ban on assault weapons and high-capacity magazines would work hand in hand with heightened school security and mental-health reform. "This measure is a significant first step as part of a comprehensive program," he said.

    Congress passed the 1994 assault-weapons ban, which Feinstein wrote, Sept. 13, 1994, and President Bill Clinton signed it into law the same day. The ban expired 10 years later, as part of the law's "sunset provision."

    Meanwhile, Vice President Joe Biden was to talk about gun control online at 1:45 p.m. EST Thursday in a "Fireside Hangout" through the Google Plus social network.

    The 30-minute online remix of President Franklin D. Roosevelt's famous radio fireside chats, moderated by "PBS NewsHour" journalist Hari Sreenivasan, was to be streamed live on the White House's Google Plus page, its YouTube channel and whitehouse.gov.

    Biden is to continue the administration's push for gun control during talks with Sen. Tim Kaine, D-Va., in Richmond Friday. Kaine was Virginia's governor during the 2007 Virginia Tech massacre in which senior-year student Seung-Hui Cho killed 32 people before taking his own life.

    Cho passed the background check because the State of Virginia FAILED to enter the data regarding his mental health into the database. If the law had been enforced as it was writen ... MAYBE the VT shooting would not have happened. Or he might have found another way to get his weapons.

    According to the Coronor's Report - no assualt weapon was used - only handguns. The shooter was under the age of 21 and would have been unable - under Conn strict gun control laws - to purchase any type of firearm.... nor would he have been able to purchase a gun due to his mental health issues even if he had been of legal age. Instead he STOLE the guns ( breaking the law ) took them onto school property ( breaking the law ) broke into the school building ( breaking the law ) before shooting 26 people ( breaking the law 26 more times ) before shooting himself ( suicide is also illegal - so he broke the law again ) in order to avoid capture ( resisting and evading arrest are both against the law - so two more counts against him. ) Somehow I don't see where passing MORE LAWS would have prevented this tragedy.

    AN OPEN LETTER FROM SHERIFF TOM JONES
    ADDRESSING HIS POSITION ON THE SECOND AMENDMENT
    AND PROTECTING OUR CITIZENS

    January 25, 2013

    Citizens and Residents of Grant County:

    Just as all of you have, I, too, have watched media coverage where fellow citizens have been injured or killed in firearms-related incidents. Regardless of how large or small the incident, or whether if happens in a home, a shopping mall, a movie theater, college or school, the results are always tragic.

    I am saddened by what I have seen across our great country, as I am sure you are, too. I have received a lot of correspondence and concerns from the citizens of Grant County asking what my position is regarding the proposed gun law changes. Because I consider myself a pro-Second Amendment Sheriff, this is a very emotional and important topic for me. I also feel that it is important to let you, the citizens, know where I stand.

    I am a firm believer that the root cause of our nation’s incidents involving firearms is not the weapon used. The focus and the responsibility for these shootings should be on the violent and disturbed people who do the shootings. The weapon should not be the focus; the focus should be the mental stability and intent of the person handling the weapon.

    As your County Sheriff, I am elected by you, the people, to uphold the laws and defend the Constitution of the United States and the Constitution of the State of Washington. Those constitutions allow law-abiding citizens a fundamental right to keep and bear arms. I do not believe those rights should be infringed upon, nor do I believe that infringing on those rights is an answer to solving the nation’s firearms concerns. I would like to make it clear that I oppose those who would try and take away these rights. I, as your Sheriff, support the citizens of this county against unconstitutional attempts to infringe on the right to keep and bear arms.

    I do believe, and strongly advocate for, legislation that calls for improved background checks for gun buyers at stores, gun shows and private sales. Also, measures and funding to verify who can legally own guns; provide funding, improved access and quality of mental healthcare; and building partnerships across communities and the nation to help reduce gun violence. This will not be a simple task, and will require the support and effort of legislators and citizens throughout our country.

    It is my honor to serve as your County Sheriff for the past two years. Although we are in trying times and some perceive our rights as citizen are being tested, I can tell you with confidence that I will continue to work hard on reducing crime in our county as well as protect the rights of the citizens I have been sworn to protect.

    I ask and encourage all citizens of Grant County to help me protect both the lives of others and protect our legal rights and freedoms which our constitutions provide.

    Wis. sheriff urges citizens to get gun training

    Wisconsin sheriff says he released an ad calling on residents to defend themselves because the old model of having a citizen call 911 and wait for help isn't always the best option.

    In the ad, Milwaukee County Sheriff David Clarke Jr. tells residents that when it comes to personal safety: "I need you in the game." He urges citizens to learn to use firearms so they can "fight back" until authorities arrive.

    The ad has drawn sharp criticism from other area officials. The president of the Milwaukee Deputy Sheriffs' Association, Roy Felber, says it sounds like a call to vigilantism.

    But Clarke says he can either whine about budget cuts that have reduced the number of deputies or call on citizens to work with officers in some situations.

    Guess none of these critics read the story about the women and kids who hid in a closet till they were found by the bad guy, then she emptied on him. He's dead, her and her kids are unharmed, the ordeal took over 10 minutes, cops did show until several minutes after it was all over. Not dissing the cops, things happen. Now lets change the story, man invades home, unarmed mother of two killed. Nope I like the story as it is, mother saves herself and children by blowing criminal away.

    Human beings only have two ways to deal with one another: reason and force.

    If you want me to do something for you, you have a choice of either convincing me via argument, or force me to do your bidding under threat of force. Every human interaction falls into one of those two categories, without exception. Reason or force, that's it.

    In a truly moral and civilized society, people exclusively interact through persuasion.

    Force has no place as a valid method of social interaction, and the only thing that removes force from the menu is the personal firearm, as paradoxical as it may sound to some.

    When I carry a gun, you cannot deal with me by force.

    You have to use reason and try to persuade me, because I have a way to negate your threat or employment of force.

    The gun is the only personal weapon that puts a 100-pound woman on equal footing with a 220-pound mugger, a 75-year old retiree on equal footing with a 19-year old gang banger, and a single guy on equal footing with a carload of drunk guys with baseball bats. The gun removes the disparity in physical strength, size, or numbers between a potential attacker and a defender.

    There are plenty of people who consider the gun as the source of bad force equations.

    These are the people who think that we'd be more civilized if all guns were removed from society, because a firearm makes it easier for a armed mugger to do his job.

    That, of course, is only true if the mugger's potential victims are mostly disarmed either by choice or by legislative fiat--it has no validity when most of a mugger's potential marks are armed.

    People who argue for the banning of arms ask for automatic rule by the young, the strong, and the many, and that's the exact opposite of a civilized society. A mugger, even an armed one, can only make a successful living in a society where the state has granted him a force monopoly.

    Then there's the argument that the gun makes confrontations lethal that otherwise would only result in injury.

    This argument is fallacious in several ways. Without guns involved, confrontations are won by the physically superior party inflicting overwhelming injury on the loser.

    People who think that fists, bats, sticks, or stones don't constitute lethal force watch too much TV, where people take beatings and come out of it with a bloody lip at worst.

    The fact that the gun makes lethal force easier works solely in favor of the weaker defender, not the stronger attacker. If both are armed, the field is level.

    The gun is the only weapon that's as lethal in the hands of an octogenarian as it is in the hands of a weight lifter.

    It simply wouldn't work as well as a force equalizer if it wasn't both lethal and easily employable.

    When I carry a gun, I don't do so because I am looking for a fight, but because I'm looking to be left alone. The gun at my side means that I cannot be forced, only persuaded. I don't carry it because I'm afraid, but because it enables me to be unafraid. It doesn't limit the actions of those who would interact with me through reason, only the actions of those who would do so by force.

    It removes force from the equation... and that's why carrying a gun is a civilized act.
