    Dear Madam Attorney General:

    Linn County Sheriff Tim Mueller wrote a letter today to Vice-President Biden in which he explicitly states that as sheriff he will not enforce laws – or allow federal officials to enforce laws in Linn County – that he alone deems to be unconstitutional. Does the making of such a threat by the sheriff in any way violate the law or jeopardize Sheriff Mueller’s standing as a law enforcement official? If so, what recourse do the people of Oregon have short of a recall election in his county?

    Sheriff Mueller should know as someone sworn to uphold the Constitution of the United States that our government has a system of checks and balances. A local sheriff does not have the authority to determine which laws will be enforced.

    I am fortunate to serve as the minister of Sunnyside Church and University Park Church, two Reconciling Congregations in the United Methodist Church, in Portland. The United Methodist Church and the United Church of Christ, in which I am an ordained minister, are both member denominations of the National Council of Churches. The faith community has long worked to reduce gun violence in America, and I personally applaud President Obama’s commitment to making our nation safer.

    In a free nation, I am entitled to my views. Sheriff Mueller is free to express his views. But neither of us is free to break to the law without consequences. Making threats to break potential laws enacted by Congress or by executive order of the president undermines Sheriff Mueller’s authority and our democracy.

    The current and past Administrations have themselves "chosen" which laws to enforce wheen it comes to illegal immigration, the distribution of weapons to foreign states, and oftern in the simple matter of paying their taxes. Thoughts ??

    At least two sheriffs in the State of Oregon have written letters to Vice President Joe Biden following his submission of ideas he proposed to Barack Obama concerning more gun control laws. Sheriff Jim Hensley of Crook County and Sheriff Tim Mueller of Linn County sent Biden similar letters in which they concluded that they would not “stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians.”

    Sheriff Hensley also sent a letter to Biden on January 15, which was almost verbatim of that of Sheriff Mueller. Hensley has served the people of Crook County as a member of the Crook County Sheriff’s Office and the Prineville Police Department for over 30 years.

    Hensley affirmed the exact same thing that Mueller did and that is that he took the same oath and takes it just as serious. He will oppose unconstitutional laws and federal agents and politicians who seek to enforce them.

    I have to confess that in writing this article I get chills. It’s not often that I have heard such patriotism in recent days. It is good to call wicked men to repent of their actions, including those within government who are seeking to be a law unto themselves. Not only are these sheriffs doing that, but sheriffs around the country are taking this stand.

    If you missed it, please read the story of Sheriff Scott Berry in Georgia who took his business elsewhere because Dana Safety Supply decided they would discriminate against law abiding citizens and not sell them semi-automatic rifles and follow that up with Colorado Sheriff Ron Bruce who said that “with my dying breath, I would protect their current/existing Constitutional Rights.”

    We owe these men tremendous honor and applaud them for their stand. If you are in the vicinity of these men or perhaps your sheriff takes a similar stand, please call them and encourage them or bake a pie and take it by to them to show your thankfulness for their dedication. These men are the defense line between us and a federal government that is getting, as my father use to say, “way to big for its britches!”

    Do Gun Control Laws Control Guns?

    The gun control controversy is only the latest of many issues to be debated almost solely in terms of fixed preconceptions, with little or no examination of hard facts.

    Media discussions of gun control are dominated by two factors: the National Rifle Association and the Second Amendment. But the over-riding factual question is whether gun control laws actually reduce gun crimes in general or murder rates in particular.

    If, as gun control advocates claim, gun control laws really do control guns and save lives, there is nothing to prevent repealing the Second Amendment, any more than there was anything to prevent repealing the Eighteenth Amendment that created Prohibition.

    But, if the hard facts show that gun control laws do not actually control guns, but instead lead to more armed robberies and higher murder rates after law-abiding citizens are disarmed, then gun control laws would be a bad idea, even if there were no Second Amendment and no National Rifle Association.

    The central issue boils down to the question: What are the facts? Yet there are many zealots who seem utterly unconcerned about facts or about their own lack of knowledge of facts.

    There are people who have never fired a shot in their life who do not hesitate to declare how many bullets should be the limit to put into a firearm's clip or magazine. Some say ten bullets but New York state's recent gun control law specifies seven.

    Virtually all gun control advocates say that 30 bullets in a magazine is far too many for self-defense or hunting — even if they have never gone hunting and never had to defend themselves with a gun. This uninformed and self-righteous dogmatism is what makes the gun control debate so futile and so polarizing.

    Anyone who faces three home invaders, jeopardizing himself or his family, might find 30 bullets barely adequate. After all, not every bullet hits, even at close range, and not every hit incapacitates. You can get killed by a wounded man.

    These plain life-and-death realities have been ignored for years by people who go ballistic when they hear about how many shots were fired by the police in some encounter with a criminal. As someone who once taught pistol shooting in the Marine Corps, I am not the least bit surprised by the number of shots fired. I have seen people miss a stationary target at close range, even in the safety and calm of a pistol range.

    We cannot expect everybody to know that. But we can expect them to know that they don't know — and to stop spouting off about life-and-death issues when they don't have the facts.

    The central question as to whether gun control laws save lives or cost lives has generated many factual studies over the years. But these studies have been like the proverbial tree that falls in an empty forest, and has been heard by no one — certainly not by zealots who have made up their minds and don't want to be confused by the facts.

    Most factual studies show no reduction in gun crimes, including murder, under gun control laws. A significant number of studies show higher rates of murder and other gun crimes under gun control laws.

    How can this be? It seems obvious to some gun control zealots that, if no one had guns, there would be fewer armed robberies and fewer people shot to death.

    But nothing is easier than to disarm peaceful, law-abiding people. And nothing is harder than to disarm people who are neither — especially in a country with hundreds of millions of guns already out there, that are not going to rust away for centuries.

    When it was legal to buy a shotgun in London in the middle of the 20th century, there were very few armed robberies there. But, after British gun control zealots managed over the years to disarm virtually the entire law-abiding population, armed robberies became literally a hundred times more common. And murder rates rose.

    One can cherry-pick the factual studies, or cite some studies that have subsequently been discredited, but the great bulk of the studies show that gun control laws do not in fact control guns. On net balance, they do not save lives but cost lives.

    Gun control laws allow some people to vent their emotions, politicians to grandstand and self-righteous people to "make a statement" — but all at the cost of other people's lives.

    National ‘assault weapon’ ban coming Thursday

    Sen. Dianne Feinstein’s office confirmed that she will be introducing in the Senate Thursday a new version of the so-called assault weapon ban. A spokesman said the full text will be released at a press conference on Thursday.

    The California Democrat intends to expand on the ban that expired in 2004, by including handguns and shotguns, in addition to rifles. She would decrease from two to one the number of cosmetic features on a gun to have it be considered an “assault weapon.” This means that if a gun has just one item like a pistol grip or bayonet lug, then it is illegal. Gov. Andrew Cuomo signed into law the same ban in New York last week.

    Furthermore, instead of grandfathering in current firearms, she would create a national gun registry for the government to track lawful gun owners. Magazines would again be limited to 10 rounds.

    The Clinton-era bill was not renewed by Congress after the Federal Bureau of Investigation and law enforcement agencies reported that it was ineffective in reducing crime.

    President Obama said that a top priority is to get “an assault weapons ban that is meaningful” passed this year.

    A summary of Mrs. Feinstein’s legislation is below.

    Bans the sale, transfer, importation, or manufacturing of: 120 specifically-named firearms; certain other semiautomatic rifles, handguns, shotguns that can accept a detachable magazine and have one or more military characteristics; and semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds.

    Strengthens the 1994 Assault Weapons Ban and various state bans by: Moving from a 2-characteristic test to a 1-characteristic test; eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test; and banning firearms with “thumbhole stocks” and “bullet buttons” to address attempts to “work around” prior bans.

    Bans large-capacity ammunition feeding devices capable of accepting more than 10 rounds.

    Protects legitimate hunters and the rights of existing gun owners by: Grandfathering weapons legally possessed on the date of enactment; exempting over 900 specifically-named weapons used for hunting or sporting purposes; and exempting antique, manually-operated, and permanently disabled weapons.

    Requires that grandfathered weapons be registered under the National Firearms Act, to include: Background check of owner and any transferee; type and serial number of the firearm; positive identification, including photograph and fingerprint; certification from local law enforcement of identity and that possession would not violate State or local law; and dedicated funding for ATF to implement registration.

    Armed citizens started to fire back at him - forcing him to cover and limiting his shots until 2 Texas Rangers and an armed civilian stormed the Tower.
